422. At the [1728th] meeting, the Committee also decided to request the Chairman to send a letter to the Government of Ukraine informing it that the Committee had considered on a preliminary basis the request submitted by the Research and Support of Indigenous Peoples of Crimea Foundation, asking the Committee to act under its early warning and urgent action procedures on the situation of the Tatars in Crimea.


423. After recalling the relevant provisions of its concluding observations adopted in 19984 and in 2001,5 and in accordance with article 9 (1) of the Convention and article 65 of its rules of procedure, the Chairman drew the attention of the State party to a list of questions to which it wished to receive a response at the latest by 31 December 2005, so that the matter could be discussed at its sixty-eighth session.


424. The Chairman also reiterated the wish of the Committee to pursue the constructive dialogue with the Government of Ukraine and to underline that this request for further information was made with a view to ensuring the implementation of the Convention in cooperation with the State party. The Committee further reminded the State party that the seventeenth and eighteenth periodic reports of Ukraine, to be submitted in one document, were due on 6 April 2004. The Committee therefore strongly encouraged the State party to submit its overdue periodic report as soon as possible.

Situation des Tatars de Crimée


1. Mme JANUARY-BARDILL indique que le Groupe de travail sur les mesures d’alerte rapide et la procédure d’action urgente, dont elle est la Présidente, a examiné deux affaires, l’unequi a trait à la situation des Tatars de Crimée, en Ukraine, et l’autre à celle des Shoshones de l’Ouest, aux États-Unis.


2. S’agissant de la situation des Tatars de Crimée, Mme January-Bardill indique que le Comité a reçu une communication du Gouvernement de l’Ukraine, datée du 26 janvier 2006, qui explique de manière satisfaisante les mesures prises par ce dernier pour fixer le statut juridique des personnes déportées en raison de leur appartenance nationale. L’Ukraine ayant répondu aux questions du Comité, le Groupe de travail recommande à ce dernier de reprendre l’examen de cette situation dans le cadre de la présentation du prochain rapport périodique de l’Ukraine, fixé à la session suivante, en août 2006.
