IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD
List of issues to be taken up in connection with the consideration of
the initial report of Andorra (CRC/C/61/Add.3)
PART I
Under this section the State party is requested to submit in written form additional and updated information, if available, (before 3 December 2001):
1. Please provide disaggregated data (by gender, age, nationality, urban or rural areas) covering the period between 1998 and 2000 on the:
(a) number and proportion of children under 18 living in the State party;
(b) number of children belonging to families with a temporary work authorization or residence;
(c) number of children with disabilities either taken of care at home or living in institutions;
(d) number of children in domestic and intercountry adoptions.
2. In light of article 4 of the Convention, please provide additional information and disaggregated data (by age and gender) on the amount and proportion of national budget, devoted to children at central and local level, preferably in the last three years (1999-2001), to:
(a) education (different types of education, i.e. primary and secondary education);
(b) health care (different types of health services, i.e. primary health care, vaccination programmes, adolescent health care and other health-care services for children);
(c) children with disabilities;
(d) support programmes for families;
(e) the protection of children who are in need of alternative care including the support of care institutions;
(f) juvenile justice.
3. With reference to child abuse, including sexual abuse, please provide disaggregated data (by age, gender and types of violations reported), on the:
4. Please provide disaggregated data (including by gender, age, nationality and urban/rural areas) covering the period between 1998 and 2000 on the:
(a) enrolment in percentage of children in pre-primary schools;
(b) enrolment in percentage of children in primary schools;
(c) enrolment in percentage of children in secondary schools;
(d) percentage of enrolled children completing primary and secondary schools;
(e) percentage of enrolled children in private schools;
(f) number and percentage of drop-outs;
(g) number of children with disabilities integrated in regular school.
5. Please provide disaggregated statistical data (including by gender and age) on adolescent health, including early pregnancy, sexually transmitted diseases (STDs), HIV/AIDS, drug and alcohol abuse covering the period between 1998 and 2000.
6. Please provide appropriate disaggregated data (including by gender, age and type of crime) covering the period between 1998 and 2000, in particular on the number of:
(a) minors, who have allegedly committed a crime, reported to the police;
(b) minors in pre-trial detention and length of their detention;
(c) minors who have been sentenced and type of punishment or sanctions;
(d) detention facilities for juvenile delinquents and their capacity;
(e) minors detained in these facilities and length of their detention;
(f) the percentage of recidivism cases.
B. General measures of implementation
1. Please indicate if the State party may reconsider its declaration with reference to articles 7 and 8 of the Convention.
2. Please provide further information on legislative measures taken to review existing laws in order to ensure compliance with the Convention on the Rights of the Child, in particular with regard to the status of the Penal Code for Minors. In addition, please provide further information on the immigration policy and to what extent it affects children belonging to immigrant families.
3. Please provide information on whether steps were undertaken to establish a coordination mechanism for ensuring the implementation of the Convention and for coordinating policies relevant to children.
4. Please indicate whether the State party envisages to establish an independent body, such as an Ombudsperson for Children or a Commission for Children, to ensure the monitoring of the implementation of the Convention.
5. Please provide information on the system for data collection and whether it covers in a disaggregated way all children under 18 and all areas under the Convention.
6. Please provide further information on measures taken to increase awareness, including training, on the Convention among government officials, professionals working with and for children and the population in general, including children. In addition, please provide additional information on how governmental institutions cooperate with non-governmental organizations, especially with reference to the participation of representatives of civil society in the design and implementation of policies and programmes for children.
Please provide copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.
Under this section, the State party is to briefly (3 pages maximum) update the information provided in its report with regard to:
- new bills or enacted legislation
- new institutions
- newly implemented policies
- newly implemented programmes and projects and their scope
The following is a preliminary list of major issues that the Committee intends to take up during the dialogue with the State party. THEY DO NOT REQUIRE WRITTEN RESPONSES. This list is not exhaustive as other issues might be raised in the
course of the dialogue.
The dialogue with the State party might include issues such as:
1. Information about the implementation in practice (e.g., in court decisions, in decisions by administrative bodies, in developing national and local policies on children's issues) of the principles of non-discrimination (art. 2), the best interests of the child (art. 3), the right to life, survival and development (art. 6) and the right of the child to be heard (art. 12).
2. Extent to which children's opinions are taken into consideration beyond the scope of the specific situations and ages covered in the report.
3. The situation and rights of children belonging to families with a temporary working authorization or residence.
4. Support to families where both the parents work, through kindergartens or other services.
5. The situation of abuse and neglect, including sexual abuse within the family, and domestic violence. Additional information on the work carried out by the technical Commission for the Care of Children. Strategies developed to prevent child abuse and mechanisms established to adequately assist both the victims and perpetrators of abuse. Further, the use of corporal punishment in families, schools, care and other institutions and whether alternative disciplinary measures have been developed to combat this practice.
6. Protection of children from harmful information through legislation, guidelines and other mechanisms, particularly with regard to the access of children to videos, television programmes and Internet sites with harmful content.
7. Equal access to health assistance for all children including, in particular, children who are neither Andorran nationals nor resident of Andorra.
8. Access and provision to adolescents of information relating to physical and mental development, including education on reproductive health, STDs and HIV/AIDS and substance abuse prevention, as well as child-sensitive counselling and rehabilitation services.
9. Implementation of legislation about sexual exploitation and trafficking of children.
10. With respect to the treatment of children in conflict with the law, issues including the treatment of children between 16 and 18, measures relating to children under 16 who commit a crime, and the conformity of legislation and practice in the area of juvenile justice with international juvenile justice standards.
