List of issues to be taken up in connection with the
consideration of the initial report of
Cyprus
(CRC/C/8/Add.24)

General measures of implementation
(Arts. 4, 42 and 44 para. 6 of the Convention)

Please provide clarification on the status of the Convention in relation to national law. Have the provisions of the Convention been invoked before the court and taken into account in judicial decisions?

Please comment on the progress made in amending previous laws to comply with the provisions of the Convention. (Paras. 5-6 of the report).

Please provide more details about the process of preparing the report, in particular the extent to which the non-governmental organizations were involved.

What is the mechanism for collecting data on the implementation of the Convention? In addition, what indicators both qualitative and quantitative have been developed to serve as bases for monitoring the extent of implementation of the Convention?

In view of the information contained in para. 18 of the report, please indicate the progress made with respect to the establishment of an inter-ministerial Commission for monitoring the implementation of the Convention.

Please describe the policy in place in relation to the implementation of article 4 of the Convention with regard to the allocation "to the maximum extent of (...) available resources for the rights of the child".

Please provide information on the measures taken to incorporate education about the principles and provisions of the Convention in training and re-training programmes for professionals working with or for children, including lawyers, judges, prison authority personnel, government officials, youth detention facility employees and police officers as well as legislators.

Does the Government intend to publish the summary records and concluding observations together with the State party report?


Definition of the child
(Article 1 of the Convention)


Please provide information on the minimum age for legal and medical counselling without parental consent, sexual majority and marriage. Are there differences between these ages for boys and girls?


General principles
(Arts. 2, 3, 6 and 12 of the Convention)

Has any evaluation been undertaken of the ways in which the principles of "the best interests of the child" and "respect for the views of the child" as provided for in the Convention are taken into account, including in administrative or judicial proceedings?


Civil rights and freedoms
(Arts. 7-8, 13-17 and 37 (a) of the Convention)

Please clarify the statement made in para. 42 of the report that "Children of citizens of the Republic of Cyprus have, in general, the right to acquire Cypriot citizenship". In this regard, please provide information on whether any differentiation is made on the grounds of the gender of the parent in relation to a child's acquisition of nationality, particularly in situations where the child is born out of wedlock and/or one parent is a non-national.


Family environment and alternative care
(Arts. 5, 18 paras. 1 and 2, 9-10, 27 para. 4, 20, 21, 11, 19 and 39 and 25 of the Convention)

Please provide further information on the status of children born out of wedlock. What services are in place to provide emotional support to single parents enabling them to provide care for their children at home?

What provision is made for pre-marital and parenthood counselling? (Paras. 50-53 of the report).

Does national legislation and other measures adequately provide for the protection of the child from information and material injurious to his or her well-being, in conformity with article 17 (e) of the Convention?

In view of the information contained in para. 64 of the report, please provide further information on the measures being taken to ensure the effective implementation of article 9 of the Convention, particularly with respect to children affected by the continuing division of the country. Please provide information on the number of children affected, disaggregated by location, gender and ethnic origin.

Is the Government considering the possibility of becoming a State party to the Hague Convention on Protection of Children and Cooperation in respect of Intercountry Adoption?

With respect to the information contained in para. 81 part (d) of the report, has any study been undertaken and have suggestions been made to the Government with regard to, inter alia, the prevention of the problem of child abuse? If the answer is yes, please provide details of the salient points of the evaluation of and discussion on this issue.

Please provide clarification as to whether children themselves can lodge complaints concerning abuse or neglect.

Please provide the results of the survey of school children below the age of 11 who are unsupervised at home. (Para. 54 of the report). How many children in such circumstances are not provided with care through community day centres? What other interventions, if any, are planned to address this issue? In this connection, please provide further details of the progress achieved in ensuring supervision and care for the children of working parents, including through encouraging the establishment of community services and programmes in areas where such facilities are inadequate and in expanding the daily programme coverage of nursery school. (Paras. 54 to 56 and 125-126 of the report).


Basic health and welfare
(Arts. 6 para.2, 23, 24, 26, 18 para.3 and 27 paras. 1-3 of the Convention)

Are accidents affecting children a problem in Cyprus? If the answer is yes, please provide information on the measures being taken to prevent and/or address these problems.

Concerning children with special needs, please provide further information on the measures taken to follow-up on the concluding suggestions contained in the report prepared by the committee investigating into this matter (see paras. 6 and 104 of the State party report).

Please provide information on the functioning of the new health education programme mentioned in para. 112 of the report.


Education, leisure and cultural activities
(Arts. 28, 29 and 31 of the Convention)

With reference to the information contained in para. 153 of the report, please provide clarification as to whether or not corporal punishment is permitted in schools.

In light of articles 29 and 42 of the Convention and in view of the adoption by the General Assembly of resolution 49/184 proclaiming the United Nations Decade of Human Rights Education, how is the Government using this opportunity to incorporate education about the Convention on the Rights of the Child in the curricula of pre-school, school and higher educational establishments.


Special protection measures
(Arts. 22, 30 and 32-40 of the Convention)

Please provide information on the implementation of articles 22, 38 and 39 of the Convention, including any factors and difficulties impeding the application of the provisions of these articles, progress achieved and priorities for action identified.

With reference to the implementation of articles 19, 22, 30 and 32-40 of the Convention, please describe the intervention used in the psychological recovery and social reintegration of children in need of special protection.

In light of the provisions of the Convention, in particular those of its articles 37, 39 and 40, and with reference to the suggestions and recommendations contained in para. 21 of the Comments adopted by the Human Rights Committee following its consideration of the initial report of Cyprus (see CCPR/C/79/Add.39), please provide information, inter alia, on whether the Government is considering the possibility of raising the minimum age of criminal responsibility and penal sanction.

Please provide clarification as to whether legislation in Cyprus prohibits the application of life imprisonment and indeterminate sentencing to persons under the age of 18 at the time of the commission of the offence.

Please furnish additional information on the measures taken to prevent any form of sexual abuse of children. Is there legislation prohibiting the production, distribution and possession of pornographic material involving children? Can citizens in the Republic of Cyprus be prosecuted for exploiting children abroad for purposes of prostitution or other illegal sexual practices?

With reference to para. 209 of the report in which the procedures for the questioning of children is described, please provide information on the situations or cases in which such procedures would be employed.

As a consequence of events in 1974 and in view of the continuing division of the country, please furnish further information on the measures being taken to address any negative consequences of this reality affecting children in the country, including with regard to reducing potential tensions among various religious or ethnic communities/groups.
