IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the
consideration of the initial report of Denmark


General measures of implementation
(Arts. 4, 42 and 44, para. 6 of the Convention)

1. Is Denmark considering the possibility of reviewing its legislation with a view to withdrawing its reservation to Article 40 (2) (b) (v) of the Convention?

2. How were non-governmental organisations, professional associations, youth groups and the public in general involved in the process of preparing the report? What action has already been taken to make the report available to the Folketing, interest groups and associations involved in matters relating to children's rights? To what extent have free copies of the State party report been sought from the Ministry of Justice? (Para. 26 of the report)

3. Are there plans to publish the Summary Records and the Concluding Observations of the discussions with the Committee on the Rights of the Child in connection with the publication of the Danish State Party report?

4. Please provide more details about the measures envisaged to make the Convention widely known to adults and children alike.

5. Is the Convention available in languages spoken by larger refugee and immigration groups? Are there other publications about the Convention, its principles and provisions, in these languages, including in forms accessible to children?

6. What is the status of the Convention in relation to national law? Can and have the provisions of the Convention been invoked in court?

7. Please describe the policy in relation to the implementation of article 4 of the Convention in regard to the allocation "to the maximum extent of (... ) available resources for the rights of the child". How has this principle been applied in budget discussions in recent times? What guarantees exist that local authorities are also guided by this principle in their policy making? How are children with special needs protected against the adverse effects of the economic recession?

8. Has Denmark's policy on development cooperation been reviewed to take into account the possibility of giving greater priority to supporting measures and programmes for the enhancement of the implementation of the Convention on the Rights of the Child?

9. What activities have been undertaken or are being planned to orient or train professional groups to develop their knowledge, skills and attitudes on the rights of the child, as well as to handle matters relating to the psychological treatment and social reintegration of the children whose rights have been violated? Please provide information in this regard, where appropriate, for the following professional groups:

(a) teachers, religions counsellors

(b) social workers, psychologists

(c) medical doctors, psychiatrists

(d) child-care givers and staff of institutions

(e) policy and military personnel

(f) lawyers, judges, prosecutors, fiscals

(g) policy makers, legislators, political leaders, executives, statisticians

(h) volunteers, journalists and other members of the media.

10. Please indicate the mechanisms in place at the Central Governmental level to monitor the implementation of the Convention and whether indicators are used to assist in this task. How do the municipal and county councils monitor and evaluate their own performance with regard to the implementation of the rights of the child so as to ensure that the most appropriate measures are taken to address new situations as they arise? Please provide further details of the ways in which non-governmental and private organisations are involved in implementing the rights of the child.


General principles
(Arts. 2, 3, 6 and 12)

11. Please provide information on the measures taken to prevent and combat racism and xenophobia.




12. How is the principle of non-discrimination interpreted in relation to the rights of refugee and asylum-seeking children and their enjoyment of the rights guaranteed under the Convention? Are the rights to, for example, health, education and family reunification protected even in the case where children have not been granted asylum?

13. How have the methods of interviewing children in the asylum process been adjusted to guarantee the right of the child to express his/her views, and to take into account the best interests of the child?


Civil rights and freedoms
(Arts. 7, 8, 13-17 and 37 (a) of the Convention)

14. Has the Government undertaken a review of its policy on keeping the identity of sperm donors anonymous in the light of the child's right to know his or her origins?


Family environment and alternative care
(Arts. 5, 18 paras. 1 and 2, 9, 10, 27 para. 4, 20, 21, 11, 19, 39 and 25 of the Convention)

15. How are the views of the child at different stages of development and discernment taken into consideration in cases of separation of parents, and in the determination of custody and visitation including the maintenance of contacts with relatives other than the child's parents? Is counselling provided to the family in such cases?

16. Is the right of the child to be in contact with both of the parents a factor taken into consideration in refugee policy, including in cases when the parents are divorced or not married?

17. Has there been any recent evaluation of the impact of the parental guidance and counselling programmes? Do these programmes reach parents who are most in need of such advice?

18. Information contained in paragraph 127 of the report indicates that an expert Committee on Custody has been established to analyse the rules laid down in the Legal Incapacity and Guardianship Act. If this Committee has completed its work, please provide details of its conclusions.

19. What mechanisms are in place for monitoring the conditions of institutions, foster homes, and other alternative care facilities for children?

20. Has an overall, and systematic evaluation of the international adoptions to Denmark been undertaken? If so, what have been the results?

21. What programmes exist to prevent abuse and neglect of children by their parents? How effective is the system of surveillance, reporting and judicial action on this matter?


Basic health and welfare
(Arts. 6 para. 2, 23, 24, 26 and 18 para. 3, 27 paras. 1-3 of the Convention)


22. Attitudes and policies towards children with disabilities sometimes have had a tendency to focus on technical aids while neglecting the emotional, intellectual and social needs of these children. Has this problem been focused on in Denmark and, if so, what have been the conclusions of that discussion?

23. What steps are being taken to address the problem of suicides among teenagers?


Education, leisure and cultural activities
(Arts. 28, 29 and 31 of the Convention)

24. To what extent does the school curriculum at different levels incorporate the subject of human rights education, in light of the provisions of article 29 of the Convention?

25. What measures are being taken to provide refugee and immigrant children and children seeking asylum with the same level of education as children whose mother tongue is Danish?


Special protection measures
(Arts. 22, 30, 32-40 of the Convention)

26. Please describe the measures taken to ensure that the situation in refugee centres are child and family friendly, especially as regards facilities for suitable play and leisure activities.

27. What measures have been taken to avoid asylum-seeking children being kept in custody while awaiting deportation? In this connections what rules, regulations or guidelines exist to guarantee that detention "shall be used only as a measure of last resort and for the shortest appropriate period of time" as provided for in article 37 (b) of the Convention? How are such detentions, if they exist, monitored and evaluated?

28. Please provide information on the functioning of the system of the administration of juvenile justice and programmes developed as alternatives to the imprisonment of juvenile offenders?

29. What initiatives have been taken to obtain reliable information about sexual abuses against children committed by Danish citizens abroad?

30. Please describe the measures taken to prevent the disproportionately high risk of occupational diseases and accidents suffered by children (para. 342 of the report). In view of the practice of employing young children in light work, has the Government considered ratifying ILO Convention No. 138?

31. Please describe the situation of children in the Farce Islands and Greenland and the difficulties met in ensuring that they enjoy all the rights provided in the Convention.
