IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the consideration of the initial report of
Denmark
(CRC/C/70/Add.6)

PART I


Under this section the State party is requested to submit in writing additional and updated information, if available, before 6 April 2001:

A. Data and statistics, if available

1. Please provide demographic data of the under-18 population, including non-Danish nationals, disaggregated by nationality, sex, and religious or other origin.

2. Please provide specific disaggregated data in percentages on national budgetary allocation and spending for social needs for the period between 1998 and 2000. In particular, how much was spent on:

a) education (including allocations for primary and secondary education, salaries, preservation of school buildings, etc.);

b) health (including allocations for primary health care, vaccinations, adolescent health care and other health care services for children);

c) child protection (for example institutional or foster care);

d) juvenile crime prevention;

e) programmes and services for child victims of abuse, including sexual abuse and neglect; and

f) social services (including for minority families).

3. Please provide disaggregated data (by sex, age, nationality, urban or rural areas), covering the period 1997-1999 on the number of children deprived of their family environment:

a) adopted domestically;

b) adopted abroad;

c) living in foster care;

d) living in institutions; and

e) living in boarding schools.

4. Please provide the following statistical data (disaggregated by sex, age, type of crime, type of sanction) concerning children in conflict with the law for the period 1998-2000:

a) number who were reported to the police for allegedly committing crimes;

b) number who were sentenced by Courts to sanctions, and the nature of the sanctions imposed (imprisonment; community service; other);

c) number dealt with outside of criminal proceedings;

d) number of suspended sentences;

e) where the sanction is deprivation of liberty, please further specify the period of detention and the nature of the offence;

f) percentage of recidivism cases; and

g) children held in solitary confinement and the duration of the confinement.

B. General Measures of Implementation

1. In light of the Declaration and Plan of Action of the Vienna World Conference on Human Rights (1993), and with reference to information provided in paragraphs 4 and 5 of the report, please indicate whether additional consideration has been given to the withdrawal of the State party's reservation to article 40 (2) (b) (v) of the Convention.

2. Please provide information concerning the status of the Convention in domestic law. Please specify whether the Convention has been invoked in domestic courts, and if so, please provide examples. Additionally, please indicate areas where law reform is still needed to ensure full conformity with the Convention.

3. Please provide information on the measures taken to ensure the effective implementation and monitoring of the Convention, including with respect to children belonging to ethnic minority groups and other vulnerable groups. Additionally, please provide information on the system of data collection as well as on the use of statistical data in formulating policies and programmes for children.

4. Please provide an update of recent measures taken to enhance awareness about the principles and provisions of the Convention, including among professional groups, children and the general public. Please highlight the efforts made to ensure that the Convention is also made available in the principal languages of refugees and migrants. Additionally, please outline the measures taken to disseminate the Initial State party report of Denmark as well as the concluding observations of the Committee on the Rights of the Child concerning this report.


PART II

Please provide the Committee with copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.


PART III

Under this section, States parties are invited, whenever appropriate, to briefly (3 pages, maximum) up-date the information provided in their report with regard to:

- new bills or enacted legislation

- new institutions

- newly implemented policies

- newly implemented programmes


PART IV

The following is a preliminary list of major issues that the Committee intends to take-up during the dialogue with the State party - THEY DO NOT REQUIRE WRITTEN RESPONSES. This list is not exhaustive as other issues may be raised in the course of the dialogue.

The dialogue with the State party might include issues such as:

1. Independent human rights monitoring mechanisms (the possibility for children to directly make complaints).

2. Gender discrimination (in employment – impact on children, especially those from single/female headed households).

3. Discrimination against ethnic minorities, including in schools and through learning materials as well as with respect to housing, employment and economic opportunities.

4. Respect for the views of the child (efforts to promote acceptance of this principle, including for children under the age of 12 years, especially in placement decisions).

5. Article 17 (access to appropriate information and efforts to protect children from racist and other harmful information).

6. Adoptions, including intercountry adoption, placement policies and cultural adoption for minorities.

7. Child abuse and domestic violence (Efforts to promote awareness, preventative and rehabilitative programmes, including for perpetrators of such abuse and violence).

8. Health concerns for young children in institutions, including day care facilities.

9. Adolescent health concerns, including sexually transmitted diseases (STDs), HIV/AIDS, early pregnancy, smoking, drug and alcohol abuse, nutrition concerns (bulimia, anorexia, obesity), violence and bullying in school, physical and sexual abuse, suicide and mental health concerns. (Efforts to promote awareness, preventative and rehabilitative programmes).

10. School dropouts (especially as regards minorities); bullying in school.

11. Children living and/or working on the streets.

12. Commercial sexual exploitation, including child prostitution and pornography (Efforts to strengthen awareness, prevention and rehabilitation, legislative initiatives against perpetrators).

13. Asylum seeking, unaccompanied children (policies and programmes to promote and protect their rights).

14. Trafficking of children (legislative and other initiatives toward prevention).

15. Juvenile justice concerns (separation of children from adults, the holding of children in solitary confinement).
