IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD


List of issues to be taken up in connection
with the consideration of the initial report of Jordan
(CRC/C/8/Add.4)


General measures of implementation
(Arts. 4, 42 and 44 para. 6 of the Convention)

1. Please provide more information about the process of preparing the initial report, especially as regards popular participation and the involvement of non-governmental organizations.

2. Please indicate what concrete measures, if any, have been taken to make the report widely available to the public at large.

3. Please indicate the measures being taken to train professional groups such as social workers, doctors, lawyers, teachers and the police as well as decision makers about the principles and provisions of the Convention?

4. Please indicate whether any study has been undertaken to review national legislation and its compatibility with the provisions and principles of the Convention on the Rights of the Child.

5. Please provide information on the measures taken to develop mechanisms for the determination of appropriate indicators as well as the collection of statistical data and other information on the status of children as bases for designing programmes to implement the Convention. Please indicate whether there is a need for technical assistance in this regard.

6. Please describe the steps taken to implement article 4 of the Convention with regard to the allocation "to the maximum extent of (...) available resources for the rights of the child", and the measures being taken to reduce the impact of economic difficulties on the situation of children, especially children from the most disadvantaged groups.

7. To what extent is international cooperation designed to enhance the implementation of the Convention and what share of international assistance is devoted to programmes which benefit children?


Definition of the child
(Article 1 of the Convention)

8. Please explain the reasons for the differences in minimum marriage ages for boys and girls and whether the Government is considering reforming national legislation in this regard, in light of the provisions of the Convention, particularly its article 2.

9. Please indicate the reasons for the differences between the minimum age for the completion of compulsory education and the minimum age for employment.


General principles
(Arts. 2, 3, 6 and 12 of the Convention)

10. Please provide information on the steps taken to prevent and eliminate discriminatory attitudes or prejudices and to ensure an effective protection against discrimination, particularly towards the girl child, disabled children and children born out of wedlock.

11. Please provide information on the measures taken to ensure the implementation of the Convention especially to the most disadvantaged groups of children, including non-Jordanian children and refugee children.

12. Please explain the ways in which the "best interests of the child" are taken into consideration in judicial, administrative or other proceedings, particularly with reference to the application of article 7 of the Personal Status Act (see paragraph 7 of the report).

13. With reference to para. 12 of the report, please provide further information as to how the provisions of articles 150 and 151 of the Personal Act, regarding breast-feeding practices, are applied in reality.

14. What concrete measures have been taken to sensitize public opinion about the need to encourage children's participatory rights?

15. In view of the information contained in paragraph 7 of the report, please indicate the ways in which the principle of respect for the views of the child is reflected in all matters affecting the child, particularly in judicial and administrative proceedings.


Civil rights and freedoms
(Arts. 7, 8, 13-17 and 37(a) of the Convention)

16. Please provide information on the measures being taken or envisaged to ensure that all children are registered after birth, particularly in rural and remote areas. In addition, please provide details of any mechanisms in place to monitor birth registration or sanction late registration.

17. Please provide further information on the channels available, including membership of associations, through which children may make their views known and have them taken into account.


Family environment and alternative care
(Arts. 5, 18 paras. 1 and 2, 9, 10, 27 para. 4, 20, 21, 11, 19, 30 and 25 of the Convention)

18. Please provide information on any family education programmes developed by the government or non-governmental organizations.

19. With reference to information contained in para. 73 of the report that the Government is studying the question of "disputed custody of children as a result of marriage to foreign women with a view to the conclusion of bilateral agreements to regulate such circumstances and problems", please indicate whether the Government has completed this study and, if so, please provide details of the results of this study.

20. Has the Government developed educational programmes to protect the child from corporal or physical punishment in schools or within the family situation?

21. Has the Government undertaken any evaluation of the effectiveness of measures taken to protect the child from abuse and neglect.

22. Please provide further information on the institutions providing alternative care for children, including any substitute parental care programmes, the number of children under such care, the reasons for children's separation from the family and any mechanisms in place to monitor the situation of children placed in alternative care.


Basic health and welfare
(Arts. 6 para. 2, 23, 24, 26, 18 para. 3 and 27 paras. 1-3 of the Convention)

23. Please provide more information on the programmes being developed to prevent disability (see para 87, part (c) of the report) and the measures being taken to promote the rights of disabled children, particularly as regards their entry into higher education.

24. Please provide information on the allocation of resources between curative and preventive health care programmes.

25. How does the government ensure that there is an equitable distribution of medicines, medical equipment and professional personnel to all health units in rural and poorer urban areas?


Education, leisure and cultural activities
(Arts. 28, 29 and 31 of the Convention)

26. Please provide information on the concrete measures being taken to improve school attendance for those children living in remote areas and to reduce the rate of school drop out.

27. Please indicate the specific measures being taken to reduce the high level of illiteracy among females.

28. Please indicate to what extent school curricula have been adjusted to give room for education about the Convention.


Special protection measures


A. Children in situations of emergency (Arts. 22, 38 and 39 of the Convention)

29. In view of the information contained in para. 138 of the report, please provide information on whether the Government has concluded its consideration of the question of Jordan becoming a State party to the 1951 Convention relating to the Status of Refugees or the 1967 Protocol relating to the Status of Refugees.

B. Children in the administration of juvenile justice system (Arts. 40, 37 and 39 of the Convention)

30. With reference to the information contained in paras. 145 and 156 of the report concerning the provisions of articles 92 and 94 of the Penal Code, please provide clarification as to the age of criminal responsibility.

31. Please provide further information on the programmes developed to provide for the rehabilitation of children in the administration of juvenile justice system, in the light of articles 37, 39 and 40 of the Convention.

C. Children in situations of exploitation (Arts. 32, 33, 34, 35, 36, and 39 of the Convention)

32. Please provide clarification as to the application in practice of the provision of Article 302 of the Penal Code which relates to the penalties proscribed for the abduction and rape of a victim who was a married female under 15 years of age, in light of the information contained in para. 1 part (d) of the report which states that the minimum age of marriage for females is 15.

33. Please provide information on how the provisions of Article 311 of the Penal Code are applied in practice (see para. 183 of the report). In addition, please provide further information on the concrete measures being taken to protect children from sexual exploitation, particularly as information contained in para. 154 of the report indicates that a sizeable number of girls are begging on the streets.

34. Please indicate whether the Government has the intention to become a party to ILO Conventions relating to the protection of children in situations of employment and the protection of children against economic exploitation, in particular, ILO Convention No. 138 concerning Minimum Age for Employment.
