IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the consideration of
the initial report of Monaco (CRC/C/28/Add.15)

Part I


Under this section the State party is requested to submit in written form additional and updated information, if available (before 6 April 2001):


A. Data and statistics

1. Please provide disaggregated data, for 1998, 1999, 2000 and 2001, on budget allocations (including as a percentage of the total budget) for primary, secondary and special education and for primary, adolescent and other child related health services (for example, via schools).

2. Please provide data on the number of children with disabilities in the State party, and on the numbers living with their families and/or living in institutions. Please also indicate how many children with disabilities attend regular schools and how many attend other schools.

3. Please provide disaggregated data on the numbers of children living within the State party enrolled in primary and secondary education, indicating also whether their education institution is within the State party or not. Please also provide information on the numbers of children who complete their primary and secondary education as a proportion of the total numbers of eligible children and the total numbers of children who enrol.

4. Please provide recent statistical data (including by gender, age and type of crime) covering the period between 1997 to 2000 on the:

1) number of minors who were sentenced by Courts to sanctions, and the nature of sanctions (community service; detention; other types of sanctions);

2) the number of juveniles detained and imprisoned, the location of their detention or imprisonment (e.g. police station, jail or other place), whether children are held in separate facilities from adults and the lengths of their detention or imprisonment, including pre-trial detention.

3) percentage of recidivism cases;

4) number of children, when deprived of liberty, maintaining contact with family and how often.


B. General Measures of Implementation

1. Please explain the State party's child rights policy. Please provide information explaining the mechanisms through which State policy with regard to children's rights is formulated and the means through which policy implementation is co-ordinated. Please also indicate whether the State party has a human rights plan of action.

2. Please explain the mechanisms that exist for monitoring the State party's implementation of the Convention. In particular, please provide information on any independent human rights monitoring mechanisms that may exist.

3. Please provide additional information on the percentage of budgetary resources used to implement the Convention.

4. Please provide further information on the State party's efforts to disseminate the Convention to all sectors of the population.

5. Please provide additional information on the role of NGOs in implementing the Convention in the State party, including the names and activities of relevant NGOs. Please also explain whether any efforts have been made to promote the role of civil society in implementing children's rights.


Part II

Please provide the Committee with copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.


Part III

Under this section, States parties are invited, whenever appropriate, to briefly (3 pages maximum) up-date the information provided in their report with regard to:

- new bills or enacted legislation

- new institutions

- new policies

- newly implemented policies

- newly implemented programmes and projects


Part IV

The following is a preliminary list of major issues that the Committee intends to take-up during the dialogue with the State party. THEY DO NOT REQUIRE WRITTEN RESPONSES. This list is not exhaustive as other issues might be raised in the course of the dialogue.

The dialogue with the State party might include issues such as:

1. Consideration given to withdrawing State party reservations to the Convention.

2. Clarification of whether, under domestic legal practice, fathers and mothers have the same rights and benefit from the same State assistance in the context of, inter-alia, parenting rights and financial assistance to families.

3. Description of the main child rights policy and implementation co-ordination mechanisms. Explanation of child rights monitoring mechanisms exist.

4. Extent to which children's opinions are taken into consideration beyond the scope of the specific situations and ages covered in the report.

5. Respect for a child's rights to know the identity of his or her parents, in the light of the State party report which refers to several situations in which a child may not be able to obtain information on the identity of parents - including through abandonment at birth or a decision by a mother to give up her child at birth.

6. Discrimination between men and women in terms of the granting of Monegasque nationality to children, and gender discrimination in terms of the inheritance rights of children.

7. Protection of children from harmful information through legislation, guidelines or other mechanisms, particularly with regard to the access of children to videos, television programmes and internet sites with harmful content.

8. Equal benefit of fathers and mothers from the provision of financial assistance by the State in the context of assistance to families. Access of fathers to financial assistance if they interrupt their professional activities to look after their child.

9. Equal distribution of parental responsibility, under law, between fathers and mothers.

10. Ratification of the Hague Convention on the protection of children and co-operation in international adoptions.

11. Equal access to health assistance for all children including, in particular, children from disadvantaged families and who are neither Monegasque nationals nor residents of Monaco.

12. The right of all children to leisure.

13. Monitoring by the State party of the evolution of French policy towards refugee applicants, and action taken to address concerns regarding respect for relevant international law expressed by independent commentators, in so far as French policy affects refugee applications to Monaco.

14. Mechanisms used by the State party to ensure that children, below the minimum age of labour, who work under the authority of a parent and in an establishment which only employs family members are protected from exploitation and any harmful effects related to their labour, including for example, long work hours.
