IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of Issues to be taken up in connection with the consideration of
the second periodic report of Morocco (CRC/C/93/Add.3)

PART I

Under this section the State party is requested to submit in written form additional and updated information, if possible, before 4 April 2003:

A. Data and statistics, if available for 2000, 2001 and 2002

1. Please provide disaggregated statistical data (by gender, age groups and regions) covering the period 2000-2002 the number and proportion of children under 18 living in the State party;

2. In light of article 4 of the Convention, please provide additional information and disaggregated data (by age and sex) on the amount and proportion in percentages of the national budget and/or GDP, devoted to children at central and local levels, preferably in the last 3 years (2000-2002), to:
(a) education (different types of education, i.e. preprimary, primary and secondary education, salaries, preservation of school buildings, etc.);
(b) health care (different types of health services, i.e. primary health care, vaccination programmes, adolescent health care and other health care services for children);
(c) children with disabilities;
(d) social welfare support to families, day care centres, foster families and institutions;
(e) juvenile justice;
(f) please indicate the State allocations paid as subsidies to the private sector and NGOs in all above mentioned sectors, when applicable, and criteria for payments. 3. Please provide disaggregated data (including by sex, age) covering the period between 2000 and 2002, in percentages of the relevant age groups, in public and private schools on the:
(a) rate of literacy below and over 18 years;
(b) enrollment in percentage of children in preprimary and primary schools;
(c) enrollment in percentage of children in secondary schools;
(d) percentage of enrolled children completing primary and secondary schools;
(e) number and percentage of drop-outs and repetition;
(f) ratio teacher per children and ratio of qualified teachers; 4. Please specify the number of children with disabilities, disaggregated by sex and age:
(a) living with their families;
(b) in institutions;
(c) attending regular schools;
(d) attending special schools.

5. Please provide disaggregated statistical data (including by gender, age, region) on adolescent health, including early pregnancy, sexually transmitted infections (STIs), mental health, suicide, drug, alcohol and tobacco abuse as well as rates of infant and child mortality and of malnutrition covering the period between 2000 and 2002. Also, please provide numbers of health professionals working in the health care services for children

6. Please provide appropriate disaggregated data (including by sex, age, type of crime, type of sanction) covering the period between 2000 and 2002, in particular on the number of:
(a) minors, who have allegedly committed a crime, reported to the police;
(b) minors who have been sentenced and type of punishment or sanctions;
(c) detention facilities for juveniles in conflict with the law, as well as their capacity;
(d) minors detained in these facilities;
(e) the percentage of recidivism cases;
(f) reported cases of abuse and maltreatment of children occurred during their arrest and detention.

7. With reference to special protection measures, please provide statistical data (including by sex, age, urban/rural areas) per year between 2000 and 2002 on the number of children:
(a) involved in sexual exploitation, including prostitution, pornography, sale and trafficking and the number of those children who were provided access with rehabilitation treatments;
(b) involved in substance abuse and the number of those children who received rehabilitation treatments;
(c) living in the streets and the number of them receiving social reintegration;
(d) involved in child labour (formal or informal sectors, and domestic work).

B. General Measures of Implementation

1. While noting the partial implementation of recommendations of the Committee's previous concluding observations (CRC/C/15/Add.60, 30 October 1996, paras.17-29), please provide further information about follow-up measures taken for the implementation of the not yet fully implemented recommendations.

2. In light of the previous Committee's recommendation (Ibid., para. 20) and of the recommendations adopted in the Declaration and Plan of Action of the Vienna World Conference on Human Rights (1993), please indicate what consideration has the State party given to the possibility of reviewing its reservation upon article 14 of the Convention with a view to its withdrawal.

3. Please provide information on cases where the Convention has been directly invoked before domestic courts.

4. Please provide further information on special mandate, role and activities of the Ministry of Human Rights, and on the progress made by the Ministerial Committee (within the Ministry of Human Rights) to harmonise domestic legislation with the international human rights instruments including the Convention. In that regard, what has been the follow-up of the draft presented to the Government by the National Observatory on the Rights of the Child?

5. The State party report indicates that the Ministry of State in charge of Social Care, Family and Child Affairs is responsible for the coordination of the activities for the implementation of the Convention with reference to the activities of various ministries. Please provide information on which body is in charge of the implementation of the Convention [mandate, human and financial resource, etc.] If any overlap or duplication exists in the functions of the various ministries, what is done to remedy this?

6. Please provide information on the evaluation which has been done on the 1992 national plan by the National Commission and on the status of the new Plan of Action which was under preparation at the time of drafting of the State party report and on the possible role of the aforementioned Commission in that regard.

7. Please provide information on the role of the National Observatory of the Right of the Child in monitoring the implementation of the Convention. Does this structure also ensure the monitoring of the National Plan of Action? Is this institution also competent to address individual complaints?

8. With regard to data collection, please provide information on the National Board of Statistical Information, should this body been established.

9. Please indicate the level of public awareness and the nature of public debate which followed the dissemination of the previous concluding observations and how effective have the State's public awareness-raising campaigns of the Convention been, particularly with respect to professionals working for/and with children (eg. of Government officials, legislators, community-based organizations, religious leaders, the mass media), and the public at large, including children themselves.

10. Please provide additional information on how governmental institutions cooperate with non-governmental organisations, especially with reference to the participation of representatives of civil society in the design and implementation of policies and programmes for children.

11. Please indicate the issues affecting children that the State party considers to be priorities requiring the most urgent attention with regard to the implementation of the Convention.


PART II

Please provide copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.


PART III

Under this section, the State party is to briefly (3 pages maximum) up-date the information provided in its report with regard to:

- new bills or enacted legislation
- new institutions
- newly implemented policies
- newly implemented programmes and projects and their scope.


PART IV

The following is a preliminary list of major issues (that does not contain issues already covered in Part I) that the Committee intends to take up during the dialogue with the State party. They do not require written responses. This list is not exhaustive as other issues might be raised in the course of the dialogue.

1. Implementation of the general principles of the Convention, such as non-discrimination (article 2), the best interests of the child (article 3), and the right of the child to express views and have them taken into consideration (article 12).

2. With respect to the definition of the child, issues such as the minimum age for marriage and the minimum age for access to employment or apprenticeship.

3. Measures taken to eliminate discrimination of women and girls (e.g. in personal status matters, including, marriage, divorce, inheritance, maintenance, and child custody upon separation), as well as discrimination of children born out of wedlock.

4. Implementation of civil rights and freedoms (articles 13-17) contained in the Convention.

5. Children deprived of family environment: the situation of children placed in "social institutions".

6. With respect to ill-treatment of children, issues such as legal provisions to protect children from being ill-treated, mechanisms for children to file complaints and have them addressed, and preventive measures including awareness campaigns on its negative consequences.

7. Measures taken to decrease infant, child and maternal mortality rates and to ensure a better access to quality health services, particularly in rural areas. Reproductive health for adolescents, notably in light of the progression of HIV/AIDS and measures taken to curb this phenomenon.

8. With respect to children with disabilities, issues such as adequate access to services, public awareness campaigns to combat negative attitudes, support for families and steps for inclusion in regular schools.

9. In the area of education, issues such as the quality of education, in-service and pre-service training of teacher, the costs of education, high repetition and drop-out rates, discrimination against girls and children from rural areas.

10. Children affected by the situation in Western Sahara.

11. Migrant children: the situation of children who are expelled from foreign countries (notably Spain) where they enter illegally and their treatment once they are back in Morocco.

12. In the area of economic exploitation, issues such as children involved in the traditional craft industry or in hazardous work, and child maids.

13. Child prostitution and measures taken to combat this phenomenon and to rehabilitate children who have been involved in prostitution.

14. The situation of street children and their status with regard to the Penal Code.

15. With respect to the treatment of juvenile offenders, issues including the reform of the juvenile justice system; the living conditions in the detention centres; the rehabilitation of children who have committed an offence.

16. Minority: rights of children belonging to minority groups including their rights to enjoy their own culture.
