IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of Issues to be taken up in connection with the consideration of
the second periodic report of Myanmar (CRC/C/70/Add.21)


PART I

Under this section the State party is requested to submit in written form additional and updated information, if possible, before 5 April 2004:

A. Data and statistics


1. Please provide disaggregated statistical data (by sex, age groups and States and Divisions) for the years 2001, 2002 and 2003 on the number and proportion of children under 18 living in the State party.

2. Please provide disaggregated statistical data on birth registration for the years 2001, 2002 and 2003, including estimates on children not registered.

3. In light of article 4 of the Convention, please provide additional information and disaggregated data (by age and sex) on the amount and proportion in percentages of the national budget and/or GDP, devoted to children at central and local levels, preferably in the last 3 years (2002, 2003 and 2004), to:
(a) education (different types of education, i.e. pre-primary, primary and secondary education, salaries, preservation of school buildings, etc.);
(b) health care (different types of health services, i.e. primary health care, vaccination programmes, adolescent health care and other health care services for children);
(c) children with disabilities;
(d) social welfare support to families, day care centres, foster families and institutions;
(e) juvenile justice;
(f) please indicate the State allocations paid as subsidies to the private sector and NGOs in all above mentioned sectors, when applicable, and criteria for payments.

Please also indicate the percentages of these allocations derived from international sources and its connection to expenses for children's rights.

4. Please provide disaggregated data (including by sex, age) for the years 2001, 2002 and 2003, in percentages of the relevant age groups, in public and private schools on the:
(a) enrollment in percentage of children in pre-primary and primary schools;
(b) enrollment in percentage of children in secondary schools;
(c) enrollment in percentage of children in tertiary schools;
(d) percentage of enrolled children completing primary and secondary schools;
(e) number and percentage of children not attending any schools;
(f) number and percentage of drop-outs and repetition;
(g) ratio teacher per children and ratio of qualified teachers;
(h) rate of literacy below and over 18 years.

5. Please specify the number of children with disabilities, disaggregated by sex and age:
(a) living with their families;
(b) in institutions;
(c) attending regular schools;
(d) attending special schools; and
(e) not attending any schools.

6. Please provide disaggregated statistical data (including by sex, age, States and Divisions) on deliveries made at medical centres and outside, adolescent health, including early pregnancy, sexually transmitted infections (STIs), mental health, suicide, drug, alcohol and tobacco abuse as well as rates of infant and child mortality and of malnutrition for the years 2001, 2002 and 2003. Also, please provide numbers of health professionals working in the health care services for children

7. Please provide disaggregated statistical data (including by sex, age, States and Divisions) on the number of children:
(a) infected by HIV/AIDS
(b) affected by HIV/AIDS
(c) heading households due to HIV/AIDS
(d) orphans of HIV/AIDS living in extended families or institutions.

8. Please provide appropriate disaggregated data (including by sex, age, type of crime, type of sanction) covering the period between 2001 and 2003, in particular on the number of:
(a) Persons under 18 years, who have allegedly committed a crime, reported to the police;
(b) Persons under 18 years who have been sentenced and type of punishment or sanctions;
(c) detention facilities for persons under 18 years in conflict with the law, as well as their capacity;
(d) persons under 18 years detained in these facilities;
(e) the percentage of recidivism cases;
(f) reported cases of abuse and maltreatment of persons under 18 years occurred during their arrest and detention.

9. Please provide disaggregated statistical data (including by sex, age, States and Divisions) on the number of Rohingya children:
(a) registered at birth;
(b) who have access to education and health care; and
(c) who are disabled.

10. With reference to special protection measures, please provide statistical data (including by sex, age, States/Divisions) per year between 2001 and 2003 on the number of children:
(a) Recruited in the army or otherwise victims of armed conflict and on those who receive recovery and reintegration services;
(b) involved in sexual exploitation, including prostitution, pornography, sale and trafficking and the number of those children who were provided access with rehabilitation treatments;
(c) involved in substance abuse and the number of those children who received rehabilitation treatments;
(d) living in the streets and the number of them receiving social reintegration;
(e) involved in child labour (formal or informal sectors, and domestic work).

B. General Measures of Implementation

1. The Committee would appreciate receiving detailed information on concrete and time bound activities related to recommendations contained in the Committee's previous concluding observations (CRC/C/15/Add.69 of 24 January 1997), which have not been implemented, in particular those related to the reform of national legislation (para. 28), the right to citizenship (para. 34), the recruitment of under-age children (para. 42) and the juvenile justice system (para. 46). Please explain the obstacles to implementation and how the State party envisages overcoming them.

2. Please provide additional information on the system for data collection and whether it covers in a disaggregated way all children under 18 and all areas under the Convention.

3. Please provide more specific information on the status and authority of the National Committee on the Rights of the Child (NCRC) in charge of the coordination of the implementation of the Convention. How NCRC does relate with the authorities in each State and Division and at the local level?

4. Please provide information on the development regarding the establishment of a national commission for children following the creation of a Committee on Human Rights. In light of the Paris Principles (GA resolution 48/134, annex) and the Committee's General Comment no. 2 (CRC/GC/2002/2), the Committee is particularly interested in information on ensuring its independence and its role in monitoring the Convention.

5. Please outline the measures taken to introduce a more systematic and sustainable approach to training, education and awareness-raising on the principles and provisions of the Convention, particularly among professional groups, including magistrates and others in the justice system, teachers, social workers, police and military personnel, and community and religious leaders as well as parents.

6. Please indicate the issues affecting children that the State party considers to be priorities requiring the most urgent attention with regard to the implementation of the Convention.
Part II

Please provide copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.

Part III

Under this section, the State party is to briefly (3 pages maximum) up-date the information provided in its report with regard to:

- new bills or enacted legislation
- new institutions
- newly implemented policies
- newly implemented programmes and projects and their scope
Part IV

The following is a preliminary list of major issues that the Committee intends to take up during the dialogue with the State party. They do not require written responses. This list is not exhaustive as other issues might be raised in the course of the dialogue.

1. General principles of the Convention (articles 2, 3, 6 and 12) and their practical implementation by social welfare institutions, courts of law and administrative authorities.

2. Birth registration, with a particular regard to minority groups and children in rural areas and the right to citizenship.

3. Enjoyment by children of their civil rights (articles 13 to 17 of the Convention), in particular the possibility to receive and send information

4. Corporal punishment in the family, schools and other institutions.

5. Alternative care for children separated from their families.

6. Domestic and inter-country adoptions.

7. Child abuse, including sexual abuse

8. The provision of health care.

9. Education, including with regard to the quality of education, enrolment in primary and secondary schools, the access of vulnerable groups to education and the role of the private sector in that regard

10. The situation of internally displaced children and families and that of returnees.

11. Economic exploitation, including child labour

12. Sexual exploitation and trafficking of boys and girls.

13. Street children

14. The overall situation of the administration of juvenile justice, including length and conditions of pre-trial detentions, occurrence of torture and ill-treatment.

15. The situation of children belonging to ethnic and/or religious minorities
