IMPLEMENTATION OF THE CONVENTION OF THE RIGHTS OF THE CHILD


List of issues to be taken up in connection with the
consideration of the second periodic report of Peru

(CRC/C/65/Add.8)

GENERAL MEASURES OF IMPLEMENTATION
(Arts. 4, 42 and 44, para. 6 of the Convention)

1. Please provide further information regarding the process of implementation of the Children and Adolescents Code (1992) as well as Decree 895 (Ley contra Terrorismo Agravado) and Decree 899 (Ley contra Pandillaje Pernicioso).

2. With regard to the information provided in the report (annex on social statistics, 1994-1995), please indicate how this data has been used to develop indicators for all areas covered in the Convention.

3. In addition to the information on the National Development Plan (1996-2000)and in view of the Committee's recommendation (CRC(C/15/Add.8, para. 19), please indicate whether an evaluation of the impact of the above mentioned plans and programmes exists, and whether new programmes have been envisaged after the year 2000. Please also indicate whether the State party has conducted an evaluation of the impact of the economic reforms on children.

4. Please provide information regarding the implementation of Legislative Decree 776, which aims at redistributing resources from the richer to the poorer communities according to demographic, territorial and social criteria.

5. With regard to information provided in the report (paras.91-96), please provide further information on how governmental institutions cooperate with non-governmental organizations, especially concerning the participation of representatives of civil society in the design and implementation of policies and programmes for children.


GENERAL PRINCIPLES
(Arts. 2, 3, 6 and 12 of the Convention)

6. With regard to the implementation of article 2 of the Convention, please provide information on progress achieved on the implementation of specific policies and programmes in order to change traditional attitudes towards gender roles. Please also provide further information on measures taken against the discrimination of vulnerable groups of children (e.g., children with disabilities, children living and or working in the streets, children belonging to indigenous and Black-Peruvian communities). Furthermore, please provide further information on measures taken to reduce regional disparities, especially concerning access to health services and education.

7. In light of article 6 of the Convention and with regard to the Committee's recommendation (see CRC/C/15/Add.8, para. 16), please indicate measures taken to protect children living in "emergency zones" from the negative impact of terrorist and anti-terrorists campaigns.


CIVIL RIGHTS AND FREEDOMS
(Arts. 7, 8, 13-17 and 37(a) of the Convention)

8. In view of the Committee's concern (see CRC/C/15/Add.8, para.13) and the information contained in the report (paras.260-272), please provide further information on measures taken by the State party to continue fostering children's participatory rights, in particular regarding the participation of children in care institutions.

9. With regard to the Committee's recommendation (CRC/C/15/Add.8, para. 16) please indicate whether investigations, such as those recommended by the Committee in 1993, were carried out and whether any of these cases involved persons under the age of 18. Please also indicate the number of cases of police brutality against children which have been submitted to domestic courts. Finally please indicate whether rehabilitation has been provided for the victims of such crimes.


Family environment and alternative care
(Arts. 5, 18(1) and (2), 9, 10, 11, 19, 20, 21, 25, 27 (4), and 39)

10. With regard to information provided in the report (paras. 430-449), please provide further information on measures taken or envisaged to improve the usage of alternative care measures, in particular of domestic adoption and foster care for children deprived of a family environment.

11. In view of the information provided in the report (paras. 435-448), please provide further information about the allocation of additional resources, both financial and human, to prevent and combat domestic violence, in particular physical and sexual abuse of children. Has the State party envisaged further measures, including educational ones, to prohibit and eliminate the use of corporal punishment within the family, at schools, and in other institutions?


Basic Health and Welfare
(Arts. 6, para. 2, 23, 24, 26, and 18, para. 3, and 27, paras. 1-3)

12. In view of the information on the existing disparities between rural and urban areas regarding infant mortality, maternal mortality rates and access to health services, please provide further information on existing plans and strategies to reduce these disparities.

13. With regard to adolescent health issues and especially in view of the high rate of teenage pregnancies in the State party, please provide further information on the impact and achievements of the "Reproductive Health Programme". Please provide further information on the measures taken to adapt reproductive health education programmes to the special needs of the population living in the Andean highlands and in the Amazonia region, which have the highest rates of infant mortality and maternal mortality.

14. With regard to the information provided in the report (paras. 465-491), please provide updated information on the implementation of the National Plan of Action on Disabilities and measures taken to guarantee the full integration, social inclusion and individual development of children with disabilities in the spirit of article 23 of the Convention. Please also provide information on the role of the National Council for the Integration of People with Disabilities.

15. In view of the information provided in the report regarding the standards of living, please provide further information in relation to poverty alleviation measures, especially with regard to children belonging to the most disadvantaged groups (e.g. indigenous population, Black-Peruvians, children living and/or working in the streets and children from urban poor and marginalized areas).


Education, Leisure and Cultural Activities
(arts. 28, 29, and 31)

16. Please provide updated information on the implementation of the Medium and Long-Term Plan on Education. Has this Plan included measures to reduce existing disparities between urban and rural areas regarding children's drop-outs from school, repetition and illiteracy rates? Please also provide further information on how the State party guarantees and monitors the right of working children to education.

17. Please also indicate plans to improve the coverage provided by the Community Educational Homes-Wawa Wasi programme, in order to overcome regional disparities.


Special Protection Measures
(Arts. 22, 30, and 32-40 of the Convention)

18. Please provide further information on the existing measures to remove land-mines planted in the State party's territory during the border conflict with Ecuador.

19. Please provide updated information on the situation of children belonging to internally displaced families, especially regarding their access to education and to health and other social services.

20. With regard to the information provided in the report (paras. 781-803) concerning to the administration of juvenile justice system, please indicate what progress has been achieved to address the Committee's recommendation on this issue (see CRC/C/15/Add.8, para.18).

21. Please also provide specific information on the measures taken to overcome the limitations described in the report regarding the full implementation of the new juvenile justice system, in accordance with the Convention and the Children and Adolescents Code. In particular, please inform on measures taken to sensitize judges and lawyers on the principles and provisions of the Convention and the Children and Adolescents Code, and measures to improve detention centres' limited capacity to promote the rehabilitation and social integration of children in conflict with the law.

22. In view of the information on child labour (paras. 863-907) and in light of the Committee's recommendation (see CRC/C/15/Add.8, para.20) in this area, please indicate progress achieved in the implementation of this recommendation. Please also indicate whether the State party has envisaged ratifying the ILO Convention No. 138 regarding minimum age for admission to employment (1973) and ILO Convention No. 182 Concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour (1999).

23. With regard to information provided in the report (paras. 931-943), please provide information on the implementation in practice of the Penal Code and its effectiveness in combating sexual exploitation and abuse of children. Please also indicate whether studies have been conducted on the scope and causes of this problem. Please provide further information on the plans to adopt a comprehensive plan of action taking into account the recommendations of the 1996 Stockholm World Congress against Commercial Sexual Exploitation of Children.

24. Please provide information on the causes and scope of sale, trafficking and abduction of children. Please provide information on measures taken by the State party to combat this phenomenon in accordance with article 35 of the Convention.

25. In light of article 30 of the Convention, please indicate further measures undertaken, including in the framework of the International Decade of the World's Indigenous People, to promote and protect the rights of children belonging to indigenous communities, in particular, regarding the enjoyment of their economic and social rights enshrined in the Convention.
