IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the consideration of
the second periodic report of SLOVENIA (CRC/C/70/Add.19)


Part I

Under this section the State party is requested to submit in written form additional and updated information, if possible, before 28 November 2003.

A. Data and statistics, if available

1. Please provide disaggregated data (by gender, age groups, ethnic groups, urban and rural areas) covering the years 2000, 2001 and 2002 on the number and proportion of children under 18 living in the State party.

2. In light of article 4 of the Convention, please provide additional disaggregated data for the years 2001, 2002 and 2003 on budget allocations and trends (in percentages of the national and regional budgets or GDP) allocated to the implementation of the Convention, specified as follows:
a) education (different types of education, i.e. pre-primary, primary and secondary education);
b) health care (different types of health services, i.e. primary health care, vaccination programmes, adolescent health care and other health care services for children);
c) programmes and services for children with disabilities;
d) support programmes for families;
e) support for children living below the poverty line;
f) the protection of children who are in need of alternative care including the support of care institutions;
g) programmes and activities for the prevention of and protection from child abuse, child sexual exploitation and child labour;
h) programmes and services for street children and abandoned children;
i) juvenile justice.
Please also indicate the expenses of the private sector, in particular for health and education.

3. With reference to children deprived of a family environment and separated from parents, please provide disaggregated data (by gender, age groups, ethnic groups, urban, and rural areas) for the years 2000, 2001 and 2002 on the number of children:
a) separated from their parents;
b) placed in institutions;
c) placed with foster families;d) adopted domestically or through inter-country adoptions.

4. Please specify the number of children with disabilities, disaggregated by sex, age and ethnic group, covering the years 2000, 2001 and 2002:
a) living with their families;
b) in institutions;
c) attending regular schools; and
d) attending special schools.

5. With reference to child abuse, please provide disaggregated data (by age, gender, ethnic groups and types of violations reported) over the period between 2000 and 2002 on the:
a) number of reports received per year in the last three years;
b) number and percentage of reports which have resulted in either a court decision or other types of follow-up.

6. Please also provide disaggregated data (by gender, age groups, ethnic groups, urban and rural areas) covering the years 2000, 2001 and 2002 on:
a) the enrolment and completion rates in percentages of the relevant group in pre-primary schools, in primary schools and in secondary schools;
b) number and percentage of drop-outs and repetitions;
c) ratio teacher per children.

7. Please provide disaggregated statistical data (by gender, age groups, ethnic groups, urban and rural areas) on early pregnancy, sexually transmitted diseases (STDs), suicide, drug, alcohol and tobacco abuse as well as rates of infant and child mortality and of malnutrition covering the years 2000, 2001 and 2002. Also, please provide numbers of health professionals working in the health care services for children.

8. Please provide disaggregated statistical data (including by gender, age groups, ethnic groups, urban and rural areas) on children infected or affected by HIV/AIDS, as well as information on programmes implemented to address the problems of these children.

9. Please provide disaggregated statistical data (including by gender, age groups, ethnic groups, urban and rural areas) on children living in poverty.

10. Please provide appropriate disaggregated data (including by gender, age, ethnic groups, and type of crime) covering the years 2000, 2001 and 2002, in particular on the number of:
a) minors, who have allegedly committed a crime, reported to the police;
b) minors who have been sentenced and type of punishment or sanctions related to offences including length of deprivation of liberty;
c) detention facilities for juvenile delinquents and their capacity;
d) minors detained in these facilities and minors detained in adult facilities;
e) minors kept in pre-trail detention and the average length of their detention;
f) reported cases of abuse and maltreatment of children occurred during their arrest and detention.

11. With reference to special protection measures, please provide statistical data (including by gender, age, urban/rural areas) covering the years 2000, 2001 and 2002 on:
a) the number of children involved in sexual exploitation, including prostitution, pornography and trafficking;
b) the number of children involved in sexual exploitation who received rehabilitation treatments;
c) the number of unaccompanied minors, asylum-seeking and refugee children.


B. General Measures of Implementation

1. Please provide information on the reasons some of the recommendations contained in the Committee's previous observations (CRC/C/15/Add.65) have not yet been fully implemented, in particular those related to (i) a strengthening of mechanisms to enhance the coordination of policies in the field of children's rights (paragraph 21) and (ii) the recommendation that information be gathered and a comprehensive study initiated to improve the understanding of the nature and scope of the problem of child abuse, with a view to setting up appropriate preventive programmes (paragraph 25). Furthermore, please provide more information on the measures taken, in line with the Committee's previous recommendations (paragraph 23), under the Programme for Employment Action Programme for Slovenia (mentioned in paragraph 42 of the State party's report) aimed at young people who have not completed school.

2. Please provide additional information concerning the State party's withdrawal of its reservation to article 9(1) of the Convention in 1999, mentioned in paragraphs 7 and 11 of the report, and indicate the reasons why the instrument of withdrawal has not yet been formally received by the United Nations Office of Legal Affairs in New York.

3. Please further provide information on cases where the Convention has been directly invoked in courts.

4. Please provide updated information on the status of the deliberations on the proposal to appoint a special ombudsman for children's rights (paragraph 24 of the State party's report).

5. In view of information brought to the attention of the Committee that decisions of the Constitutional Court pertinent to the rights of the Covenant have in some cases not been implemented, please provide information on existing procedures to ensure the implementation of decisions of the Constitutional Court.

6. Please provide information on the status of the Child Protection Act, which is currently being drawn up and which, according to information provided in the State party's report, "will provide systemic regulation for the area of children's rights in Slovenia and will lay down the basic mechanisms for the coordination of action in cases of abuse or neglect of children" (paragraph 25 of the State party's report).

7. With regard to the information provided in the State party's report that "local communities are directly responsible for the setting-up, functioning and funding of social services for children" (paragraph 44 of the State party's report), please provide information on any mechanisms in place to monitor the quality of such services.

8. Please provide information on the status of the proposed new Parental Leave and Family Benefits Act, including on the proposed special benefits for parents of disabled children and the 20 per cent increase in child benefits (paragraphs 126 and 166 of the State party's report).

9. Please provide further information on efforts to provide training, awareness and information on the Convention and on human rights in general.


Part II

Please provide the Committee with copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.


Part III

Under this section, the State party is to briefly (3 pages maximum) up-date the information provided in its report with regard to:

- New bills or enacted legislation
- New institutions
- Newly implemented policies
- Newly implemented programmes and projects and their scope.


Part IV

The following is a preliminary list of major issues (that does not contain issues already covered in Part I) that the Committee may take up during the dialogue with the State party. They do not require written answers. This list is not exhaustive as other issues might be raised in the course of the dialogue.

1. Non-discrimination, including the situation of refugee children and children belonging to the Roma community and other ethnic groups.
2. The situation of children with disabilities.
3. The implementation of the obligation for the best interests of the child to be a primary consideration.
4. Respect for the views of the child, with special regard to administrative and judicial procedures.
5. Regulations and practice concerning the separation of children from parents, including the right to maintain contact with both parents.
6. Adolescent health, including substance abuse and stress related disorders.
7. Child abuse, including sexual abuse, and neglect in the family, foster care and institutions.
8. Alimony and enforcement of decisions concerning maintenance obligations.
9. Adoption and protection of children placed in foster care.
10. Child poverty and support provided to vulnerable groups, including single-parent families.
11. Support and protection provided to refugee and asylum seeking children, including unaccompanied children.
12. Juvenile justice.
13. Trafficking.
