IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the
consideration of the initial report of Spain
(CRC/C/8/Add.6)


General measures of implementation
(Arts. 4, 42 and 44, para. 6 of the Convention)

1. Please provide more details about the process of preparing the report, in particular with regard to popular participation and the involvement of non-governmental organizations.

2. To what extent have school curricula been adjusted to give room for education about the Convention? What measures have been taken to train professional groups about the Convention?

3. What is the status of the Convention in relation to national law? Can the provisions of the Convention be invoked in court?

4. Please provide information on the present status of the draft Bill of Children's Rights.

5. Please provide further information on existing coordination, with regard to child related policies, between the Central Government, the Autonomous Communities and the local authorities.

6. Please describe the steps being taken to implement article 4 of the Convention in regard to the allocation "to the maximum extent of (...) available resources for the rights of the child". Please indicate the measures being taken to ensure that regional disparities do not develop in relation to the provision of social services and that children throughout the country are protected against the adverse effects of any reductions in budgetary allocations, especially to the social sector.

7. What share of Spain's official international assistance is devoted to programmes which benefit children in the least developed countries?


General principles
(Arts. 2, 3, 6 and 12 of the Convention)

8. Please indicate for each of the four principles, (a) progress made in implementation, (b) difficulties encountered and (c) implementation priorities.


Civil rights and freedoms
(Arts. 7, 8, 13-17 and 37(a) of the Convention)

9. Please indicate the steps being taken to protect children from violence and other harmful influences in the mass media.

10. What concrete steps have been taken to protect individual children, for instance those who are victims of sexual abuse, from harmful exposure in the mass media?

11. Please provide the data available on the occurrence of ill-treatment to children. Have specific programmes for the prevention of ill-treatment to children been developed in every Autonomous Community (para. 193 of the report)? With reference to information contained in para. 143 of the report, please explain the difference between "punishments in moderation" and "treatment with excessive harshness".


Family environment and alternative care
(Arts. 5, 18 paras. 1 and 2, 9, 10, 27 para. 4, 20, 21, 11, 19, 39 and 25 of the Convention)

12. Please describe the protection measures in place to support the family, including, in particular, the case of single-parent families.

13. Please report on the research undertaken into the problem of ill-treatment and sexual abuse of children, including into the social factors which influence such violations. What procedures exist for intervention by the authorities in cases where a child needs protection from serious abuse within the family? Can children lodge complaints of abuse or neglect?

14. Please indicate the Government's policy on alternative care for children as regards the choice between institutional care and care in foster homes or similar arrangements.

15. Please describe the procedures governing intercountry adoption, including those relating to its monitoring and supervision.

16. Please indicate the steps taken to address the problem of suicides among children.


Basic health and welfare
(Arts. 6 para. 2, 23, 24, 26 and 18 para. 3, 27 paras. 1-3 of the Convention)

17. Please provide information on the occurrence and treatment of HIV infection among children and parents as well as measures to prevent AIDS.

18. What steps are taken to promote breast-feeding?

19. Please indicate the measures taken against the high consumption of alcohol and tobacco, and provide information on rehabilitation programmes available for drug addicts.


Education, leisure and cultural activities
(Arts. 28, 29 and 31 of the Convention)

20. Please indicate whether human rights education is provided for and whether school curricula have been adapted to give room for education about the Convention.


Special protection measures

a. Children in situations of emergency (Arts. 22, 38 and 39 of the Convention)

21. What further measures are being taken, besides those of a legislative nature, to prevent and combat xenophobia and attacks against immigrants and members of minority groups?

22. What measures are envisaged to improve the access of refugee children to welfare programmes?

b. The administration of juvenile justice (Arts. 40, 37 and 39 of the Convention)

23. With regard to the system of administration of juvenile justice in the State party, please provide information on the alternatives to imprisonment for children aged between 16 and 18 who have committed an offence. Please indicate the measures taken to ensure the social reintegration of these children, preferably in their own environment.

c. Children in situations of exploitation (Arts. 32, 33, 34, 35, 36 and 39 of the Convention)

24. Please indicate the measures being taken to regulate child labour, particularly within the informal sector and small family enterprises.

25. What steps have been taken by the Government to implement ILO Conventions Nos. 77 and 78 concerning Medical Examination of Young Persons in the light of recent ILO recommendations on this matter?

d. Children belonging to a minority or an indigenous group (Arts. 30 of the Convention)

26. Please provide details of the measures being taken to protect and promote the rights of children from the gypsy minority.
