IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD


List of issues to be taken up in connection
with the consideration of the initial report
of Sri Lanka
(CRC/C/8/Add.13)

General measures of implementation
(Arts. 4, 42 and 44, para. 6 of the Convention)


1. Please provide more details about the process of preparing the report, in particular with regard to the involvement of non-governmental organisations.

2. What concrete measures have been taken to make the report widely available to the general public? What plans or programmes exist to raise public awareness about the rights of the child?

3. Can the provisions of the Convention be invoked in Court.If the answer is yes, have any of the Convention's provisions been cited in court decisions?

4. Please list any new legal codes or amendments to existing laws which have been adopted, in the light of the principles and provisions of the Convention, since the submission of the report.

5. Please provide information on the measures taken to establish or improve the mechanisms for collecting statistical data and other necessary information about the status of children to be used as a basis for designing programmes for the rights of the child. Please indicate whether there is a need for technical assistance in this area.

6. To what extent has international co-operation been designed to enhance the implementation of the Convention? What share of international assistance is devoted to programmes which benefit children?


General Principles

(a) Non-discrimination (Art.2)

7. Please provide details of the specific and concrete measures taken to combat discrimination against girls, rural children, children belonging to minorities, refugee children and children born out of wedlock, including measures to eliminate and prevent discriminatory attitudes and prejudices.

8. What efforts are being made to collect disaggregated data for groups of children on aspects relating to the application of the Convention?

(c) The right to life survival and development (Art. 6)

9. Please indicate the steps taken to create an environment conducive to ensuring "to the maximum extent possible" the survival and development of the child.

(d) Respect for the views of the child (Art. 12)

10. What concrete measures have been taken to sensitize public opinion and educate personnel working with and for children about the need to encourage children's participatory rights?


Civil rights and freedoms
(Arts. 7, 8, 13-17 and 37 (a))

11. Please indicate the measures taken or envisaged to ensure that all children, including children born out of wedlock, are registered after birth. Do sanctions exist in the case of failure to register or untimely registration?

12. What concrete steps have been taken to investigate cases of ill-treatment of children and to prevent its occurrence?

13. Is corporal punishment allowed in schools or other institutions for children?


Family environment and alternative care
(Arts. 5, 18 paras. 1 and 2, 9, 10, 27 paras. 4, 20, 21, 11, 19, 39 and 25 of the Convention)

14. What legislative measures have been adopted to protect the child against abuse and maltreatment as laid down in art. 19 of the Convention? What procedures exist for intervention by the authorities in cases where a child needs protection from serious abuse within the family? Can children lodge complaints concerning abuse or neglect?

15. What steps, if any, are being planned to support the care of children whose parents are working abroad?

16. Have programmes been adopted to prevent and reduce the abandonment of children and, if so, are such programmes adequate?

17. What concrete steps have been taken to ensure full implementation of article 11 of the Convention?


Basic health and welfare
(Arts. 6 paras. 2, 23, 24, 26 and 18 paras. 3, 27 paras. 1-3 of the Convention)

18. What proportion of the budget is allocated to child health care? Please comment on the balance between curative and preventive health programme.

19. Please provide more information on the measures taken to ensure that no child is deprived of the right of access to health care services and in particular to improve access to health care, including in rural areas, for girl children, and in disadvantaged urban areas.

20. Please provide information on the situation of disabled children with regard to the effective access to and receipt of health care services, preparation for employment and recreation opportunities.

21. What concrete measures have been taken for the implementation of article 18, para. 3, of the Convention?

22. What results have been achieved in accordance with the aims set out in the National Plan of Action for children?


Education, leisure and cultural activities
(Arts. 28, 29 and 31 of the Convention)

23. What is being done to facilitate school attendance in remote areas? What concrete measures are being taken to prevent children from dropping out of school, engaging in employment, and what are their results?

24. What measures are being taken to improve the quality and relevance of education and the quality of teaching? What plans are there to ensure a sufficient number of teachers in the school system, to enhance their competence, and to ensure adequate educational facilities? How many training institutions are there and how many persons graduate from these institutions each year?

Special protection measures

a. Children in situations of emergency (Arts. 22, 38 and 39 of the Convention)

25. To what extent is the Government's policy towards refugee and displaced children consistent with the principles of non-discrimination, the best interests of the child, the right to life, survival and development, and respect for the views of the child?

26. What concrete measures have been taken for the implementation of article 39, in particular what rehabilitative services are available for children who have been affected by situations of military conflict?

b. Children in conflict with the law (Arts. 37, 39 and 40 of the Convention)

27. Please provide more detailed information on the following questions:

- The prohibition of unlawful or arbitrary deprivation of liberty;

- The number of children deprived of their liberty and the reasons why;

- The possibility of prompt access to legal and other assistance and of challenging the legality of the deprivation of liberty before a court or other competent, independent and impartial authority;

- Measures taken to implement article 40 of the Convention.

28. Please provide further information on the treatment of young law offenders and, in particular, on the following questions:

In the institutions which exist for the custody of young law offenders

- How are the conditions in such institutions monitored?

- What possibilities are there for contact with relatives?

- Are there complaint procedures in cases of ill-treatment?

- What education and health facilities exist in these institutions?

- Are the personnel in these institutions received training about the provisions of the Convention and about international rules concerning the treatment of young offenders?

c. Children in situations of exploitation (Arts. 32 -36 and 39 of the Convention)

29. Are there any plans to make a detailed study of the possibility of ratifying ILO Convention No. 138?

30. Please provide information on the penalties or other sanctions which exist to ensure the effective enforcement of article 32 of the Convention. What are the procedures for imposing such sanctions? In addition, please provide information, if available, on the number of inspection visits made and of sanctions imposed.

31. What measures have been adopted to address the situation of children in domestic service?

32. What measures have been taken to protect children from all forms of sexual abuse or sexual exploitation, including child prostitution and child pornography?
