IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of issues to be taken up in connection with the consideration of
the Periodic report of Sudan (CRC/C/65/Add.17)

Part I


Under this section the State party is requested to submit in written form additional and updated information, if available, before the 9th August 2002.

With regard, in particular, to questions under Part 1.(a) please indicate, where applicable, which regions of the State Party are covered by the information provided and which are not covered.

A. Data and statistics


1. Please provide disaggregated data (by gender, age, minority groups, urban or rural areas) covering the years 1998, 1999 and 2000 on the number and percentage (of the total national population) of children under 18 living in the State party.2. In light of article 4 of the Convention, please provide additional information and disaggregated data (by age and gender) on the amount and proportion of the national budget, devoted to children at central and local levels, preferably in the last 3 years (1999-2001) with regard to:
a) Education (including pre-primary, primary and secondary education).
b) Health care (including different types of health services, including primary health care, vaccination programmes, adolescent health care and other health care services for children).
c) Children with disabilities.
d) Support to families and the protection of children who are in need of alternative care including the support of care institutions.
e) Juvenile justice.
f) Please also indicate the percentages of these allocations derived from international sources.

3. Please provide disaggregated data (by gender, age, minority groups, urban or rural areas) covering the years 1998, 1999 and 2000 on the:
a) Rates of infant and child mortality.
b) Proportion of children with low birth weight.
c) Proportion of children affected by malnutrition.
d) Number of children with disabilities; the number who require assistance and who are taken care of at home, and the number living in institutions.
e) Number of orphans and abandoned children, and the number living in institutions.
f) Number of children in domestic and intercountry adoption programmes.

4. Please provide disaggregated data (by age, gender and types of crimes reported), on the:
a) Number of reports of crimes committed against children received by police and courts per year in 1999, 2000 and 2001.
b) Number and percentage of reports which have resulted in either a court decision or other types of follow-up.

5. Please provide disaggregated data (including by gender, age, and urban/rural areas) for the years 1999 to 2001 in percentages of the relevant age group on the:
a) Rate of literacy below and over 18 years.
b) Percentages of children enrolling in primary and in secondary schools; the percentage of enrolled children completing primary and secondary schools; and the number and percentage of drop-outs.
c) Average ratio of teachers per children in classrooms, with an indication of any significant regional or rural/urban disparities.
d) Number of children with disabilities integrated into regular schools.
e) Number of special schools, and places available, for children with disabilities and in need of special education facilities.

6. Please provide disaggregated statistical data including by gender, age, minority groups and region, on adolescent health, including with regard to the incidence of sexually transmitted diseases, HIV/AIDS, early pregnancy, female genital mutilation and drug abuse covering the years 1999 to 2001.

7. Please provide appropriate disaggregated data (including by gender, age, minority groups and type of crime) on children in conflict with the law for the last three years (1999-2001), including:
a) The number of children who have allegedly committed a crime reported to the police.
b) Where applicable, the numbers of children held in pre-trial detention and the average duration of such detention.
c) The number of children sentenced by Courts.
d) The nature of sanctions (fines, detention, community service, other) and the number of suspended sentences.
e) Where the sanction is deprivation of liberty, please further specify the period of detention and the type (juvenile, adult or other) of detention facility in which children are held.
f) The percentage of recidivism cases.
g) The number of reported cases of abuse and maltreatment of children that occurred during their arrest and detention.

8. Please provide disaggregated data (by gender and age) covering the years 1998, 1999 and 2000 on the numbers of children recruited into armed forces and the numbers of children living in the street.

B. General Measures of Implementation


1. Please provide information with regard to those recommendations contained in the Committee's October 1993 concluding observations (CRC/C/15/Add.10) which have not yet been implemented. Please indicate, in particular, what obstacles have hindered implementation and what plans are underway to ensure implementation in the near future.

2. Please clarify the current role of the State Party in implementing the Convention within areas of the country controlled by opposition forces, with particular regard to Southern Sudan. Please indicate, where relevant, the role of other actors in implementing the Convention in these regions.

3. Please briefly explain the current process of decentralising responsibility for the provision of services to local authorities. In this regard, please indicate any problems that may exist in the provision of services to children by local authorities, for example in terms of sufficient human and financial resources.

4. Please make an assessment of the current role filled by international cooperation in facilitating the State Party's implementation of the Convention. The State Party report indicates that international assistance has been reduced in numerous areas; in this regard please indicate in which areas assistance has been reduced and why.

5. Please indicate efforts underway to minimise the impact of the armed conflict upon children and to end the conflict altogether.

6. Please provide information on mechanisms for monitoring of the Convention's implementation in the State party.

Part II


Please provide the Committee with copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.

Part III


Under this section, the State party is to briefly (3 pages maximum) up-date the information provided in its report with regard to:

- New bills or enacted legislation
- New institutions
- Newly implemented policies
- Newly implemented programmes and projects and their scope

Part IV


The following is a preliminary list of major issues that the Committee intends to take-up during the dialogue with the State party. THEY DO NOT REQUIRE WRITTEN RESPONSES. This list is not exhaustive (and does not contain issues already covered in Part I) as other issues might be raised in the course of the dialogue.

The dialogue with the State party might include issues such as:

1. Compatibility of domestic legislation with the provisions and principles of the Convention

2. Weak or non-existent infrastructure with regard to, inter-alia, water, sanitation, health services, and wide disparities between regions.

3. Implementation and coordination and National Plan of Action

4. Children's survival and development

5. Discrimination based on gender, disabilities, ethnic or religious background

6. Low levels of birth registration

7. Ill-treatment and violence, including institutionalised and legalised corporal punishment

8. Poor health conditions and services, and efforts to address health concerns including sexually transmitted diseases and HIV/AIDS

9. The situation of children with disabilities and their access to health and education services

10. The practice of female genital mutilation

11. Early marriage

12. Very low school enrolment rates and extremely limited capacity within the national education system

13. Lack of opportunities for leisure and cultural activities

14. The situation of refugee and internally displaced children, and family reunification

15. The recruitment of children as soldiers, demobilisation, the killing of civilians and destruction of facilities used by them, the obstruction of humanitarian assistance

16. The slavery and abduction of children

17. Economic exploitation

18. The administration of juvenile justice
