IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD

List of Issues to be taken up in connection with the consideration of the initial report of Turkey(CRC/C/51/Add.4)

PART I


Under this section the State party is requested to submit in written form additional and updated information, if available (before 6 April 2001):

A. Data and statistics

1. Please provide disaggregated data (by sex, age, minority group or ethnic origin, regions, urban or rural areas) covering the period between 1998 and 2000 on the:

a) number and proportion of children under 18 living in the State party;

b) number and proportion of children with disabilities;

c) number of children with disabilities either taken care at home or living in institutions;

d) number of children in domestic and intercountry adoptions;

e) number of children living in institutions;

f) number of children living in foster care;

g) number of children living in the streets;

h) number and proportion of female headed households.

2. In light of article 4 on the implementation of the Convention and with reference to the information provided in paragraphs 45-51 of the report, please provide additional information and disaggregated data (by age, sex and region) on the amount and proportion in percentage of national budget, allocated to children at central and local levels, preferably in the last 3 years (1999-2001), evaluating also the order of priority given to these policies within the comprehensive budget, to:

a) education (different types of education, i.e. primary and secondary education);

b) health care (different types of health services, i.e. primary health care, vaccination programmes, adolescent health care and other health care services for children, including social insurance);

c) children with disabilities;

d) the protection of children who are in need of alternative care including the support of care institutions;

e) birth registration;

f) juvenile justice.

3. With reference to the information provided in paragraph 125 of the report, please provide disaggregated data (by age, sex and types of violations reported), on the number of reports:

a) on violence against children per year between 1998 and 2000;

b) which have resulted in either a court decision, such as the removal of the child from his/her family, or other types of follow-up.


4. Please provide disaggregated data (including by sex, age, minority group or ethnic origin, regions, and urban/rural areas) covering the period between 1998 and 2000 on the rate of:

a) literacy below and over 18 years;

b) enrollment in primary schools;

c) enrollment in secondary schools;

d) completion of primary and secondary schools;

e) drop-outs;

f) and number of children in boarding school;

g) and number and location of boarding schools;

h) and number of children who attend private minority schools;

i) and number of children who attend pre-school education;

j) and number of children with disabilities who are enrolled in regular education and how many benefit from the special education system, as described in paragraph 308 of the report.


5. Please provide disaggregated statistical data including by sex, age, minority group or ethnic origin and region, on adolescent health, including sexually transmitted diseases (STDs), HIV/AIDS, early pregnancy, drug and alcohol abuse covering the period between 1998 and 2000.

6. In light of articles 37, 40 and 39 of the Convention, please provide appropriate disaggregated data (including by sex, age, minority group or ethnic origin, region, and type of crime) covering the period between 1998 and 2000, in particular on the:

a) number of minors who were reported to the police for allegedly committing crimes;

b) number of minors who have been sentenced by Courts to sanctions and the nature of the sanctions imposed (imprisonment; community service; other);

c) detention facilities for juvenile delinquents and their capacity;

d) number of minors detained in these facilities;

e) percentage of recidivism cases;

f) number of reported cases of abuse and maltreatment of children occurred during arrest and detention.

7. With reference to special protection measures, please provide statistical data (including by sex, age, urban/rural areas) per year between 1998 and 2000 on the number of children:

a) involved in sexual exploitation, including prostitution, pornography and trafficking;

b) involved in sexual exploitation who received rehabilitation treatments;

c) involved in substance abuse who received rehabilitation treatments;

d) seeking asylum, refugee or internally displaced;

e) who are under 14 and involved in child labour.


B. General Measures of Implementation

1. With regard to the information provided in paragraph 60 of the report concerning the establishment in 1994 of a Commission in the Ministry of Justice to examine international treaties with a view to reflecting them in the domestic legal system, please provide information on the outcome of this process. Further, please provide information on whether some laws were identified as being incompatible with the Convention. In addition, please indicate if the State party may reconsider its reservations to articles 17, 29 and 30 of the Convention.

2. With regard to the information provided in paragraph 53 of the report, please provide additional information on the General Directorate of the Social Services and Child Protection, in particular on its mandate, composition, financial and human resources and its coordination with national and local administration and the Provincial Social Services Management. Further, please provide information of the Child Rights Higher Council of CRC Monitoring and Evaluation and the sub-committee for the Monitoring and Evaluation of Child Rights established under the Prime Ministry in May 2000 and also indicate whether there is a focal point on children issues within the Government. In addition, please provide further information on measures taken to ensure the monitoring of the implementation of the Convention by an independent body, such as an Ombudsperson on Children.

3. Please provide additional information on the National Plan of Action for children updated in 1996, in particular on its implementation within the framework of the 1997-2000 Government of Turkey and UNICEF Master Plan of Operations and its overall evaluation. Please also indicate the percentages of allocations to children derived from international sources and provide more information on the provisions and financial implications for children in the Eighth Five-Year Development Plan (2001-2005).

4. Please provide further information on measures taken to increase awareness on the Convention among government officials and the population in general. Please provide additional information on how governmental institutions cooperate with non-governmental organisations, especially with reference to the participation of representatives of civil society in the design and implementation of policies and programmes for children.


PART II

Please provide copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects, when available. If possible, please submit these texts in electronic form.


PART III


Under this section, States parties are invited, whenever appropriate, to briefly (3 pages maximum) up-date the information provided in their report with regard to:

- new bills or enacted legislation

- new institutions

- newly implemented policies

- newly implemented programmes


PART IV


The following is a preliminary list of major issues that the Committee intends to take-up during the dialogue with the State party. THEY DO NOT REQUIRE WRITTEN RESPONSES. This list is not exhaustive as other issues might be raised in the course of the dialogue.

The dialogue with the State party might include issues such as:

1. Steps undertaken to review the legislation on the age of marriage of girls with a view to ensuring the same age for girls and boys.

2. Legislation, policies and programmes implemented and/or foreseen to prevent discrimination against the most disadvantaged groups of children, in particular children living in rural areas, especially in the south-eastern regions, children of Kurdish origin, the rural and urban poor, girls, displaced children and those born out of wedlock and to ensure their rights in compliance with the Convention.

3. The implementation in practice (e.g., in court decisions, in decisions by administrative bodies, in developing national and local policies on children's issues) of the principles of non-discrimination (art.2), the best interests of the child (art.3), the right to life, survival and development (art. 6) and the right of the child to be heard (art.12).

4. Steps undertaken to enforce the registration of children, in particular children living in the south-eastern region.

5. Availability, quality and efficiency of primary health care and social welfare services for children, in particular for children with disabilities and those living in the eastern part of the country. Steps undertaken to reduce the still high rates of infant and child mortality in particular in the south-eastern part and in poor urban areas.

6. The situation of abuse and neglect, including sexual abuse within the family, and domestic violence. Strategies developed to prevent child abuse and mechanisms established to adequately assist both the victims and perpetrators of abuse. Further, the use of corporal punishment in families, schools, care and other institutions and whether alternative disciplinary measures have been developed to combat this practice.

7. Information on the practice of "honour killings" and whether measures have been undertaken to combat this practice.

8. Reported cases of children, in particular children of Kurdish origin and children living and/or working in the street, who have been the victims of torture or other cruel, inhuman and degrading treatment, including cases of police brutality.

9. Impact of measures taken to encourage regular attendance at school and to reduce the number of children not attending compulsory primary school, in particular among girls and children belonging to more disadvantaged groups. Human rights education in school curricula.

10. Further information on children under 14 who are economically exploited and measures undertaken to combat this situation. Impact of the ILO IPEC Programme. Measures taken to solve the inconsistencies on the minimum age for child labour.

11. Information on whether measures were envisaged to provide teaching also in the Kurdish language in areas mainly inhabited by Turks of Kurdish origin and to provide education to asylum seeking children.

12. Information on the situation of internally displaced children and of children living in the streets.

13. The juvenile justice system (children in conflict with the law) with particular attention to the following topics:

a) deprivation of liberty as a measure of last resort;

b) situation of children in pre-trial detention;

c) situation of children subject to State Security Courts;

d) use of alternative measures;

e) practical provision of legal aid;

f) conditions of children in detention and imprisonment;

g) continued contact between the child and his/her family;

h) effective monitoring of facilities;

i) the separation of children from the general prison population;

j) complaints procedures to deal with issues such as ill-treatment and violations of children's rights;

k) education, health and social services for children in detention;

l) programmes to ensure the physical and psychological recovery and social reintegration of children;

m) whether measures are foreseen to extend the Law on Juvenile Courts also to children 15-18 years of age.
