IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD
List of issues to be taken up in connection with the consideration of the initial report of
Uzbekistan (CRC/C/41/Add.8)

PART I

Under this section the State party is requested to submit in writing additional and updated information, if possible, before 1 August 2001:

A. Data and statistics, if available

1. Please provide demographic data of the under-18 population, disaggregated by district, sex, ethnic and religious background.

2. Please provide specific disaggregated data on national budgetary allocation and spending for social needs for the last three years, as percentages of total state expenditures. In particular, how much was spent on:c) child protection (e.g. institutional or foster care);
d) juvenile crime prevention, and rehabilitation; and
e) other social services.

3. Please provide the following information about children deprived of a family environment and separated from parents, disaggregated by sex, and age for the last three years, the number of children:b) placed with relatives, and institutions/children's homes;
c) placed with adoptive and foster parents; and
d) children living and/or working on the streets.

4. Please specify for the last three years the enrolment and completion rates, disaggregated by sex, age, and district, in percentages, in:
a) kindergarten;
b) elementary;
c) intermediate;
d) secondary; and
e) vocational schools.

5. Please specify the number of children with disabilities, disaggregated by sex and age:
a) living with their families;
b) in institutions;
c) attending regular schools; and
d) attending special schools.

6. Please provide the following statistical data of children (disaggregated by sex, age, type of crime, type of sanction) for the last three years:
a) number who were reported to the police for allegedly committing crimes;c) number of suspended sentences;e) percentage of recidivism cases.

B. General Measures of Implementation

1. The information at para. 58 of the State party report indicates that various authorities are responsible for "ensuring protection of the rights and interests of the child in Uzbekistan".
i) With respect to the implementation of the Convention, please indicate what role each of these institutions plays in:
a) intersectoral co-ordination and co-operation at and between central and local levels of government;
b) monitoring at central and local levels of government;
c) receiving and addressing complaints of violations of child rights; and
ii) Please specify their operating resources, including budget and human resources.

2. In light of article 15 of the Convention, and other international standards on freedom of association, please describe what efforts have been made to facilitate the involvement of civil society throughout all stages of the implementation of the Convention, including with respect to civil rights and freedoms.

3. i) Please explain the measures taken and their effectiveness with respect to the State party's public awareness campaigns of the Convention, particularly for professionals working for and with children (e.g. of Government officials, community-based organisations, religious leaders, the mass media), and the public-at-large, including children themselves.

ii) Please provide information about on-going human rights education in the school curricula, and specify the levels of education.

4. Please describe any ongoing human rights training and education activities for professionals, especially those working for and with children.
PART II

Please provide the Committee with copies of the text of the Convention on the Rights of the Child in all official languages of the State party as well as in other languages or dialects spoken, when available. If possible, please submit these texts in electronic form.
PART III

Under this section, States parties are invited, whenever appropriate, to briefly (3 pages maximum) up-date the information provided in their report with regard to:

- new bills or enacted legislation
- new institutions
- newly implemented policies
- newly implemented programmes

PART IV

The following is a preliminary list of major issues that the Committee intends to take-up during the dialogue with the State party. THEY DO NOT REQUIRE WRITTEN RESPONSES. This list is not exhaustive, and other issues may be raised in the course of the dialogue.

The dialogue with the State party might include issues such as:

1. Implementation of the general principles of the Convention, such as non-discrimination (article 2), the best interests of the child (article 3), and the right of the child to express views and have them taken into consideration (article 12).

2. Role of the Mahallyas in the implementation of the Convention (e.g. in areas such as juvenile justice, child abuse, social assistance, etc.), oversight of their activities, and right to appeal against Mahallya decisions.

3. Implementation of civil rights and freedoms (articles 13-17) contained in the Convention.

4. With respect to ill-treatment of children, issues such as legal provisions to protect children from being ill-treated, mechanisms for children to file complaints and have them addressed, and preventive measures including awareness campaigns on its negative consequences.

5. With respect to article 20 of the Convention concerning children deprived of a family environment, issues such as the deinstitutionalisation of children, mechanisms to review placement of children and monitoring of the conditions in institutions, as well as measures to improve conditions there.

6. With respect to article 21 of the Convention concerning adoption, issues such as legislation and practice, including the practice of screening prospective adoptive and foster families, monitoring and follow-up of placement of children, and intercountry adoption.

7. With respect to children with disabilities, issues such as the allocation of resources, adequate access to services, public awareness campaigns to combat negative attitudes, support for families and steps for inclusion in regular schools.

8. In light of article 24 concerning health, issues such as the allocation of resources, access to services, particularly for vulnerable groups and given increasing fee-based services, adolescent mental and physical health, STDs and HIV/AIDS prevention, and environmental pollution.

9. With respect to education, issues such as measures to increase enrolment in pre-school, primary and secondary education, address gender disparities, improve teaching methodology, and increase allocation of resources to improve school infrastructure and training of teachers

10. With respect to refugee children, issues such as ensuring legislation is in conformity with the Convention and international standards, and consideration given to formalise working agreements with UNHCR, and to ratify the refugee conventions

11. Measures to ensure protection for children in times of armed conflict.

12. In the area of child labour, issues including the involvement of children in the agricultural sector, and consideration given to ratify ILO Conventions No. 138 on minimum age for admission to employment, and No. 182 on prohibition and immediate action for the elimination of the worst forms of child labour.

13. With respect to commercial sexual exploitation of children, issues such as studies of this phenomenon, awareness-raising campaigns, and mechanisms to monitor it.

14. With respect to the treatment of juvenile offenders, issues such as the independence and expertise of professionals working with juveniles, and the conformity of legislation and practice in the area of juvenile justice with international juvenile justice standards.
