II.REVIEWOFTHERULESOFPROCEDURE p 3.Subsequenttothedecisiontakenatitstwelfthsessiontoreviewtherulesofprocedureadopted H atthefirstsessiontoadjustthemtocurrentprocedures,2/theCommitteeatitsthirteenthsession 4 requestedtheSecretariattopreparedraftamendedrules,3/whicharecontainedinannexItothe  p presentreport.Theproposalsaddressexistingrulesthatneedtobechangedandmakesuggestions  \ aboutpossiblenewrulesthatwouldseemdesirableinthelightoftheCommitteescurrentpractices. H A.Rulesthatrequirechange   4.TheexistingrulesthatneedtobechangedtoadaptthemtotheCommitteescurrentpractices  includethoseconcerningdurationofsessions(rule1),toprovideforadditionalmeetingtime;dates  ofsessions(rule2),toensurethatthefindingsoftheCommitteecanbepresentedtotheCommission  ontheStatusofWomenduringthesameyear;placeofsessions(rule3);andthepresessionworking l group(proposednewrule4_bis_).Otherchangesrefertotheprovisionalagenda(rule5),whichin X  recentyearshasbeenadoptedbeforetheendofasessionforthefollowingsession;thepracticeof D! geographicalrepresentationfortheofficersoftheCommitteeandthemembersofthepresession 0"  workinggroup(proposedrules4_bis_Ԁand50);andtheeligibilityforreelectionofmembersofthe #l! X  B.Suggestionsregardingpossiblenewrules 0"  12.ItisproposedthatthetextofsomeoftherulesbechangedtoreflecttheCommitteespractice. $X" Oneproposedchangereferstothetermofoffice(rule8).Insteadofmaintaining16Aprilasthedate $D # onwhichthetermofofficeofnewmembersbegins(because16April1982wasthedateofthefirst %0!$ elections),itissuggestedthatthetermofofficeofmembersshouldbeginonthedayfollowingtheir &"% electionbythemeetingofStatespartiesandexpireonthedayofnewelections. '#& 13.Anothersuggestedchangerelatestotheoccurrenceandthefillingofcasualvacancies(proposed )$( rules9and9_bis_).Itreflectsthepracticeofotherhumanrightstreatybodiesinobservanceofthe |*%) provisionsofarticle17oftheConvention. h+&* 14.Theproposedtextofrule48reflectstheCommitteespracticewithregardtotheadoptionof @-(, generalrecommendationspursuanttoarticle21oftheConvention.ItalsodefinestheCommittees  roleinmakingsuggestionsaddressedtobodiesotherthanStatesparties,suchasworldconferences.  AstheSecretariathadnotedthattheprovisionsofarticle21oftheConvention,andofrule45,had  notbeenadheredtoinrespectofcommentsfromStatespartiesongeneralrecommendations,it t proposesthewordingofparagraph3ofnewrule48inordertoconformtotheprovisionsofthe ` Convention.TheSecretariatrecommendsthatsuggestionsandgeneralrecommendations,upontheir L  adoptionbytheCommittee,betransmittedtoStatespartiesforcomments,whichwouldbeannexed 8  tothereportoftheCommittee. $ t 15.Itisproposedtocombinerules51and52intoonerule51undertheheading"Participationof  L  specializedagencies".Thetextreflectsthecurrentpracticeofissuingreportsofspecializedagencies  8  aspresessiondocuments.Theprovisionsofparagraph2wouldallowrepresentativesofthe $  specializedagenciestomakeoralstatements,asisthepracticeinotherhumanrightstreatybodies.   TheConventionontheRightsoftheChild,forinstance,expresslyprovidesthattheCommitteeon   theRightsoftheChildmayinvitethespecializedagenciesandothercompetentbodiestoprovide   itwithexpertadvice,whereappropriate.Representativesofthespecializedagenciesareallocated   aperiodoftimeduringtheCommitteessessioninwhichtoprovidetheCommitteewith p observationsrelevanttothereportsunderconsideration. \ 16.Inthelightofthewishexpressedbythepersonschairingthehumanrightstreatybodiesto 4 receiveinformationalsofromnongovernmentalorganizationsandasitistheCommitteescurrent  p practicetomakeuseofsuchinformation,proposednewrule52wouldencouragethoseorganizations  \ toprovidematerialstothemembersoftheCommittee.Itshouldbepointedoutthatothertreaty H bodies,suchastheCommitteeonEconomic,SocialandCulturalRights7/andtoacertainextent 4 theCommitteeontheRightsoftheChild,havetakenstepstoincreasetheparticipationofnon   governmentalorganizationsinthereportingprocessandotheraspectsoftheirwork,andhaveset   asidetimeforthemtomakeoralstatementsduringtheregularsessions.TheCommitteeon  Economic,SocialandCulturalRightsalsoreceivesoralandwrittensubmissionsfromnon  governmentalorganizationsforitspresessionworkinggroup.Inaddition,thepersonschairingthe  humanrightstreatybodies,attheir5thmeeting,recommendedthatnongovernmentalorganizations l begiventherighttomakeoralinterventions.8/Consequently,theCommitteecouldalsotakesteps X  toallownongovernmentalorganizationstobecomemoreinvolvedinitsworkandsetaside D! speakingtimeforthem. 0"  III.REVIEWOFTHEGENERALGUIDELINES $X" 17.Followingdiscussions,atthe2ndmeetingofpersonschairingthehumanrightstreatybodies, %0!$ onthepossibilityofconsolidatingthevariousreportingguidelinesgoverningtheinitialpartofeach &"% Statepartysreport,9/theCommitteemadecommentswhichwereincorporatedintothedraft '#& consolidatedguidelines.Subsequently,adrafttextofsuchconsolidatedguidelineswassubmitted (#' bytheSecretariattotheCommitteeatitsninthsession.TheCommittee,however,lackedtimetotake )$( adecisionontheamendedguidelines. |*%) 18.AnnexIItothepresentdocumentcontainsdraftamendedguidelines.Proposedparagraph3 T,'+ referstotheconsolidatedguidelinesthatshouldpermitStatespartiestoavoidrepeatingthegeneral @-(, information,whichshouldbeincludedinpartIofeachStatepartysreport,foreachtreatybody.The  consolidatedguidelinescontainedindocument_HRI_/CORE/1,coveringpartIoftheStatesparties  reports,arecommontoalltheotherhumanrightstreatybodies.  19.Theproposedadditiontoparagraph5isbasedonasuggestionmadebytheCommitteeatits ` ninthsessiontotheeffectthatdatashouldalsoberequestedonmaternalmortality,fertilityrates, L  percentageofthepopulationunder15andover65,percentageofthepopulationinruralandinurban 8  areas,andpercentageofhouseholdsheadedbywomen10/Furthermore,theCommitteerequested $ t Statespartiestomakeeffortstoprovidealldata_disaggregated_Ԁbysex,inconformitywithitsgeneral  ` recommendation9.11/  L  20.Theproposedadditiontoparagraph6reflectsthetechnicalandfinancialpossibilitiesofthe $  Secretariatanditspracticeinrespectofotherhumanrightstreatybodies.   21.Thetextofproposedparagraph8_bis_ԀreflectstheCommitteespracticeinaccordancewitharticle   18oftheConvention.   22.Thewordingofproposedparagraph9istheresultoftheCommitteesdecision,atitsthirteenth \ session,toamendtheguidelinesforthepreparationofperiodicreports.12/ H IV.RESERVATIONS  p 23.TheCommitteehasonanumberofoccasionsconsideredthequestionofreservationstothe H Convention.Atitseleventhsessionitadoptedgeneralrecommendation20onthesubject.13/Atits 4 thirteenthsession,theCommitteediscussedthequestionatlengthand,actingonthe   recommendationoftheWorldConferenceonHumanRights,14/decidedtobringagaintothe   attentionoftheStatespartiestheseriousnesswithwhichitconsideredtheproblemofreservations,  andtohavethatconcernconveyedtothe7thmeetingoftheStatesparties.  24.Alsoatitsthirteenthsession,theCommitteedecidedtoamendtheguidelinesforthepreparation l ofinitialandsubsequentperiodicreports,toincludeasectionindicatinghowStatespartieswhich X  havefiledreservationsshouldreportonthem. D! 25.PursuanttotherequestmadebytheCommitteeatitsthirteenthsession,aletterwassenttothe #l! StatespartiesthathadenteredsubstantivereservationsdrawingtheirattentiontotheCommittees $X" concern. $D # 26.TheEconomicandSocialCouncil,initsresolution1994/7of21July1994,encouragedStates &"% toconsiderlimitingtheextentofanyreservationlodgedtotheConvention,toformulatereservations '#& aspreciselyandasnarrowlyaspossible,toensurethatnoreservationwasincompatiblewiththe (#' objectandpurposeoftheConventionandtoreviewtheirreservationsregularlywithaviewto )$( withdrawingthemexpeditiously. |*%) 27.Thepersonschairingthehumanrightstreatybodies,attheir5thmeeting,tooktheviewthat T,'+ treatybodiesshouldbeinsistentinseekingexplanationsfromStatespartiesregardingthereasons @-(, formakingreservationstothehumanrightstreaties.Italsorecommendedtothetreatybodiestostate  clearlythatcertainreservationswereincompatiblewithtreatylaw.15/  28.InaccordancewiththerequestmadebytheCommitteeatitsthirteenthsession,theSecretariat t analysedallthereservationsmadebyStatespartiestotheConventionontheEliminationofAll ` FormsofDiscriminationagainstWomenandtotheotherhumanrightstreaties. L  29.Article2(d)oftheViennaConventionontheLawofTreatiesdefinesareservationasa $ t "unilateralstatement,howeverphrasedornamed,madebyaState,whensigning,ratifying,  ` accepting,approvingoraccedingtoatreatywherebyitpurportstoexcludeortomodifythelegal  L  effectsofcertainprovisionsofthetreatyintheirapplicationtothatState".Consequently,although  8  someStatesmadedeclarationstotheeffectthattheydidnotconsiderthemselvesboundbycertain $  provisionsoftheConvention,thosedeclarationshavebeencountedasreservationswhentheir   substancemeetsthedefinitionsetoutintheViennaConvention.   30.Onanumberofoccasions,ithasbeenassertedthattheConventionontheEliminationofAll   FormsofDiscriminationagainstWomenisthehumanrightsinstrumenthavingthelargestnumber p ofreservations.Theanalysissoughttodeterminetheaccuracyofthisassertion.Onthebasisofa \ crudecount,theConventionwouldindeedappeartobethehumanrightsinstrumenthavingthe H largestnumberofreservationfiledbythelargestproportionofStatesparties.Atotalof116 4 reservationshavebeenlodgedby41Statesparties,constituting30percentofthepartiestothe  p Convention(seeannexIII,tables1and3).Bycomparison,theConventionontheRightsoftheChild  \ hashad78reservationsfiledby35Statesparties,comprising22percentoftheStatespartiestothat H Convention.Twentyfivecountriesentered35reservationstotheInternationalConventiononthe 4 EliminationofAllFormsofRacialDiscrimination;24countriesfiledinall84reservationstothe   InternationalCovenantonCivilandPoliticalRights.InthecaseoftheInternationalCovenanton   Economic,SocialandCulturalRights15Statespartiesfiledreservationsto26provisions,andthe  ConventionagainstTortureandOtherCruel,InhumanorDegradingTreatmentorPunishmenthas  had22reservationsenteredby15countries.  31.However,anexaminationofthesubstantivereservationsfiledbyStatespartiestothesamelegal X  instruments,leavingasidereservationsenteredregardingtheprovisionsgoverningthesettlementof D! disputesandimplementationmechanisms,providesadifferentpicture. 0"  32.Thecrudestatisticalcomparisonbetweenthevarioushumanrightsinstrumentsistoacertain $X" extentdistortedbythestructureoftheconventionsthemselves.Thehighnumberofsubstantive $D # reservationsenteredwithregardtotheConventionontheEliminationofAllFormsof %0!$ DiscriminationagainstWomenisinpartexplainedbythefactthatmanyarticlesoftheConvention &"% havemanyparagraphsorsubparagraphsthatareveryspecificandaddressverypreciseissues. '#& Reservationsenteredtosubparagraphshavebeencountedasindividualreservations.Thisisthecase, (#' forexample,forreservationslodgedwithregardtoarticle2,subparagraphs(a),(f)and(g),article )$( 11,subparagraphs1(b),(d)and(f)andparagraph2,andarticle16,subparagraphs1(a),(c),(d),(e), |*%) (f),(g)and(h)andparagraph2. h+&* 33.SomeStatespartiesfiledmorethanonereservationtotheConventionontheEliminationofAll @-(, FormsofDiscriminationagainstWomen(uptosevenreservationseach).Thesameappliestothe  othertreaties.OneStateentered10reservationstoseveralarticlesoftheInternationalCovenanton  Economic,SocialandCulturalRightsand13totheInternationalCovenantonCivilandPolitical  RightsandtwootherStatesfiledninereservationseachtotheInternationalCovenantonEconomic, t SocialandCulturalRights. ` 34.Forthepurposesofthisanalysis,thefollowingthreecategoriesofreservationshavebeen 8  countedassubstantivereservations: $ t (a)The"general"reservations,whichdonotrefertospecificarticlesoftheConvention;theyare  L  usuallypronouncedwithregardtotheConventionassuch,andaredirectedatthescopeofthewhole  8  Convention.SomeStatespartiesreservetheirrightsonthegroundsoftheirownreligiousorlegal $  systemsand,insodoing,putinquestionthewholeConvention.Thesearethereservationsthatthe   CommitteeconsiderstobeincompatiblewiththeobjectandthepurposeoftheConvention;   (b)Reservationsto"core"articlesoftheinstruments,namely,thearticlesthatcouldbeconsidered   asconstitutingtheheartofeachofthetreaties.InthecaseoftheConventionontheEliminationof p AllFormsofDiscriminationagainstWomen,theyarearticles1to3.Theyrefermainlytothepolicy \ tobefollowedforachievingthegoalsofaninternationalinstrument,totheconstitutionandallthe H nationallawsandtheydefinetheappropriatemeasuresinallfieldsforcarryingoutthepoliciesto 4 beadopted;  p (c)Reservationstosubstantivearticles,whicharethosearticlesrelatingtodifferentareasandsub H areasofhumanrights,thatconcerntheexerciseofcertaindutiesandtheprovisionofdifferentmeans 4 towardsachievingthegoalofinthepresentcaseeliminationofallformsofdiscriminationagainst   women.InthecaseoftheConventionontheEliminationofAllFormsofDiscriminationagainst   Womentheyarearticles4to16.  35.Anaccuratecomparisonofreservationstothevarioushumanrightsinstrumentsshouldexamine  thesethreecategoriesofsubstantivereservationsseparately. l 36.TheConventionontheEliminationofAllFormsofDiscriminationagainstWomendoesnot D!
