H 8.AsignificantnumberofStatespartiestothesetreatieshavefallenbehindintheirreporting   obligationsandseveralofthetreatybodieshavedevelopedstrategiesinthisregard.Atitsthirty   eighthsessionin1990,theCommitteeontheEliminationofRacialDiscriminationdecidedthatthe  periodicityoutlinedintheConventionwouldbesatisfiedifStatespartieswouldsubmita  comprehensivereporteveryfouryearsandabriefupdatingreportinthetwoyearinterim.The  determinationofwhetherareportiscomprehensive,soastowarranttheinterimbriefupdating l report,isatthediscretionoftheCommitteeandthisdecisionisreflectedinitsconcluding X  observationsontheStatepartysreport,whichrequesttheStatepartytocoverallthepointsraised D! intheconcludingobservations.3/ThatCommitteehasalsoadoptedthepracticeofallowingStates 0"  partiestofulfiltheirpastreportingobligationsbycombiningalloutstandingreportsinone #l! document.4/TheCommitteeagainstTorturedoesnotallowfortheconsolidationofreports,butdoes $X" allowdeparturefromtheConventionsperiodicityonanadhocbasis.TheCommitteeontheRights $D # oftheChild,whichhasalargebacklogofinitialreportsawaitingreview,aswellasgrowingnumber %0!$ of_unsubmitted_Ԁreports,hasinvitedoneStatepartytosubmitaconsolidatedsecondandthirdperiodic &"% report.5/ '#& 9.Article17,paragraph1,oftheInternationalCovenantonEconomic,SocialandCulturalRights )$( makesprovisionforStatespartiestosubmittheirreportsinstages,inaccordancewithaprogramme |*%) tobeestablishedbytheEconomicandSocialCouncilwithinoneyearoftheentryintoforceofthe h+&* CovenantandafterconsultationwiththeStatespartiesandthespecializedagenciesconcerned. T,'+ EconomicandSocialCouncilresolution1988/4,whichisreflectedinrule58(2)oftheCommittee @-(, onEconomic,SocialandCulturalRights,providesthatStatesshouldsubmitaninitialreportwithin  twoyearsoftheCovenantsentryintoforcefortheStatepartyconcerned,andthereaftereveryfive  years.TheCommitteeonEconomic,SocialandCulturalRightsdoesnotallowforconsolidationof  overduereports,butagreestoreschedulingofthereportingdateswhenthisisrequestedbyStates t parties.Bothtoencourageregularreportingandexpediteitswork,thatCommitteeisalsomaking ` effortstoencouragethesubmissionof_focused_Ԁreportsconcentratingonmattersraisedinthe L  concludingobservationsontheprecedingreportoftheStateparty. 8  10.Article40,paragraph1,oftheInternationalCovenantonCivilandPoliticalRightsprovidesthat  ` reportsareduewithinoneyearoftheentryintoforceoftheCovenantfortheStatepartyconcerned,  L  andthereafterwhenevertheCommitteesorequests.Statespartiesthatsubmittedinitialreports  8  beforeJuly1981,arerequiredtosubmitreportsfiveyearsaftertheconsiderationoftheirinitial $  reportsandeveryfiveyearsthereafter,whileotherStatespartiesarerequiredtosubmitperiodic   reportstotheCommitteeeveryfiveyearsfromthedatewhentheinitialreportwasdue.6/Atits   sixtythirdsession,in1998,theHumanRightsCommitteedecidedthat thedateofsubmissionof   thefollowingperiodicreportshouldgenerallybeuptofiveyearaftertheconsiderationofthe   previousreport.Thecriteriatobeusedinthisdeterminationare:(a)delaysinsubmissionofreports; p (b)delaysinconsiderationofthesereportsifattributabletotheState;(c)qualityofthereportsand \ ofthedialogue,and(d)natureoftheconcernsandrecommendationsexpressedintheconcluding H observations.7/TheHumanRightsCommitteedeterminesthedatethatthenextreportshouldbe 4 submittedafterconsiderationofthereportbeforeitandreflectsthisintheconcludingobservations  p adoptedwithrespecttotheStateparty.IncasesofStatespartiesthatregularlysubmitreports,a  \ periodoffiveyearsisusuallynominated;whereStatespartiesreportsarelongoverdue,the H Committeewillusuallyrequirethesubmissionofareportwithinthreeyearsaftertheconsideration 4 ofthecurrentreport.   11.Inlightofthepracticeofthesebodies,andtakingintoaccounttheviewsoftheninthmeeting  ofchairpersonsofthehumanrightstreatybodies,whichencouragedtreatybodiestodevelopa  flexibleapproach,althoughavoidingthosethatmightprovideanincentivetoStatespartiestodelay  thesubmissionoftheirreports,theCommitteeontheEliminationofDiscriminationagainstWomen l maywishtoreconsideritsdecision16/IIIandencourageStatespartieswithoutstandingreportsto X  submitasingledocumentconsolidatingalloutstandingreportingobligations.Incaseswherethe D! Statepartysoutstandingreportingobligationsincludetheinitialreport,theCommitteemaywish 0"  todecidethat,wheretheconsolidateddocumentfullyandcomprehensivelymeetstherequirements #l! oftheCommitteesreportingguidelinesandinadditionprovidesanassessmentofthe $X" implementationoftheConventionfromthedateatwhichtheStatepartysinitialreportfelldue,the $D # consolidatedreportsatisfiestheStatepartysreportingobligationstothatdate.Insuchcases, %0!$ however,theCommitteemaywishtoensurethatthedialoguebetweenitandtheStatepartyis &"% sustainedbyrequiringareportinlessthanfouryearsasitisentitledtodowithinarticle18, '#& paragraph1.ThereaftertheCommitteemaydecidethattheStatepartyshouldreverttoitsregular (#' fouryearreportingcycleindicatedintheConvention. )$( 12.Inaddition,inordertoensurethatStatespartiesthathavesubmittedreportsdonotfallbehind h+&* withtheirreportingobligations,theCommitteemaywishtoconsideradoptingthepracticeofthe T,'+ CommitteeontheEliminationofRacialDiscriminationandrequireStatespartiestosubmita @-(, comprehensivereportateightyearlyintervalsandabriefupdatingreportinthefouryearinterim.  AsinthepracticeoftheCommitteeontheEliminationofRacialDiscrimination,theelementstobe  addressedintheupdatingreportcouldbeidentifiedintheconcludingcommentsoftheCommittee  ontheearlierreportoftheStateparty.Inthiscontext,also,theCommitteemaywishtoconsider t whetherafullandcomprehensiveresponsetothelistofissuesandquestionsposedbythepre ` sessionworkinggroupoftheCommitteetoStatespartiespresentingperiodicreportscouldfulfil L  subsequentreportingobligationsincaseswherethesubsequentreportofaStatepartyconsideredby 8  thepresessionworkinggroupisdueordueshortlyafterthemeetingofthepresessionworking $ t group.  ` 13.TheCommitteemayalsowishtoconsiderthepracticeadvocatedbythechairpersonsofhuman  8  rightstreatybodiesandadoptedbytheCommitteeontheEliminationofRacialDiscriminationand $  theCommitteeonEconomic,SocialandCulturalRightsofconsideringimplementationoftheir   respectivetreatiesinStatespartiesthatconsistentlyfailtofulfiltheirreportingobligations,inthe   absenceofareport.   14.Whereinitialreportsareoverduebyfiveyearsormore,theCommitteeontheEliminationof p RacialDiscriminationnotifiesStatespartiesthat:(a)itshallreviewimplementationofthe \ ConventionintheStatepartyconcernedatafuturesessionandinviteoneormorerepresentatives H oftheStatepartytoparticipateinitsconsideration;and(b)inviewoftheabsenceofaninitialreport, 4 theCommitteeshallconsiderasaninitialreportallinformationsubmittedbytheStatepartytoother  p organsoftheUnitedNationsor,intheabsenceofsuchmaterial,reportsandotherinformation  \ preparedbyorgansoftheUnitedNations.8/Whereoverdueperiodicreportsareconcerned,in H additiontoencouragingconsolidationofoutstandingreportingobligations,theCommittee,after 4 informingtheStatespartiesconcernedinadvance,reviewsimplementationoftheConventionin   Statespartieswhosereportsareoverdueforfiveyearsormoreonthebasisofpreviousreports   submittedbythoseStates.9/  15.Since1990,theCommitteeonEconomic,SocialandCulturalRightshassimilarlyadoptedthe  practiceofconsideringtheimplementationoftheCovenantinrespectofStatespartieswhoseinitial l orperiodicreportsaresignificantlyoverdue.Inthiscontext,afourstepprocedurehasbeenadopted: X  (a)theidentificationofthoseStatespartieswhoseinitialorperiodicreportsarelongoverdue; D!
