CONSIDERATION OF REPORTS SUBMITTED BY STATES PARTIES UNDER ARTICLE 19 OF THE CONVENTION (agenda item 4) (continued)

Supplementary report of the Libyan Arab Jamahiriya (continued) (CAT/C/9/Add.12)

1. At the invitation of the Chairman, Mr. Hafyana and Mrs. Markhus
(Libyan Arab Jamahiriya) took places at the Committee table.

2. Mr. SORENSEN (Country Rapporteur) thanked the Libyan delegation for its extensive presentation which had provided a better understanding of the Libyan legal system. Speaking in his own name and on behalf of Mr. Burns, Alternate Rapporteur, he read out the Committee's conclusions:

"The Committee Against Torture expresses its thanks to the Libyan Arab Jamahiriya and the Libyan delegation for having provided, in the addendum to its initial report and during the presentation of that document, replies to the questions raised by the Committee during its consideration, in November 1991, of the initial report. The replies provided enable the Committee to evaluate the efforts made by the Libyan Arab Jamahiriya to implement the Convention; the Committee considers that its legal system is in conformity with the Convention.

"The Committee is awaiting with impatience the first periodic report of the Libyan Arab Jamahiriya, due in June 1994 and would be grateful if it would describe the application of the Convention article by article.

"The Committee's attention was drawn to a few cases of torture in the country in connection with which the Libyan Arab Jamahiriya took a legal action. The Committee notes the action taken by the Libyan Arab Jamahiriya and urges it to continue to take the necessary measures to eliminate and prevent torture.

"The Committee requests information on the number of cases of torture in which proceedings have been instituted and on the results of those proceedings.

"The Committee appreciates the way in which the Libyan Arab Jamahiriya, through its delegation, has made sincere efforts to reply to its questions."

3. The CHAIRMAN thanked the delegation of the Libyan Arab Jamahiriya for his explanations which had been both interesting and comprehensive and for the openness and sincerity it had displayed. The exchange of views had been most fruitful.

4. Mr. HAFYANA (Libyan Arab Jamahiriya) thanked the Committee for its understanding and patience and said that his country was determined to forge good relations with the Committee in order to create conditions conducive to the full application of the Convention against Torture.

5. The delegation of the Libyan Jamahiriya withdrew.
The meeting rose at 5.55 p.m.
