Paragraph 215

A person who was discharged by civilian judicial authorities may be brought before a different tribunal for trial, in contravention of article 14, paragraph 7.


Paragraph 216

The jurisdiction of military tribunals should be limited to military offences committed by military personnel. The State party must also avoid any person being tried or punished again for an offence for which he/she has already been finally convicted or acquitted of.
