' #' 2.1Theauthor'scommunicationappearstohavetwomaincomplaints,onebasedonthe )$) allegedharassmentsufferedbyhisfamily,inparticularhistwosons,allegedlybecauseof l*%* Mr._Barzana_'shumanrightsactivitiesandhisCroatianorigin.Thesecondcomplaintisbased R+&+ onthedecisionoftheCourtofAppeal,of1994,discontinuingtheproceedingsof 8,', investigationsrelatedtoeventswhichhadoccurredin1973. -n(- Ї2.2Between17and20September1973,Mr._Barzana_Ԁ_Yutronic_Ԁwasheldindetentionin  Chile.Hishousewasillegallysearchedandhewassubjectedtotorture,duringtheevents  knownas"Cora_Quillota_Ԁ2"whichhadtakenplaceinVillaAlemanaand_Quillota_,Province | of_Valparaso_. b 2.3On8February1993,proceedingstoascertainthecircumstancesofMr._Barzana_ . ~ _Yutronic_'sdetentionandallegedtorturewereinitiatedbeforethe3rdCriminalCourtof  d Santiago(_Tercer_Ԁ_Juzgado_ԀCriminaldeSantiago).Theproceedingsweretemporarily  J discontinued(_sobreseimiento_Ԁtemporal),on27May1994.  0 2.4On31May1994,thecasewasremittedtotheSantiagoCourtofAppeal(_Ilustre_Ԁ_Corte_    deSantiagode_Apelaci;n_),whichon28June1994,confirmedthediscontinuance   (_sobreseimiento_Ԁtemporal)decreedbythe3rdCriminalCourtofSantiago(_Tercer_Ԁ_Juzgado_ x  CriminaldeSantiago)inthecase.Theauthorallegesthattheseproceedingswere ^  discontinuedinapplicationoftheamnestydecreeof1978,whichheclaimsviolatehuman D  rights.Furthermore,heclaimsthattheauthoritiesdidnotinvestigatediligentlysincehigh *z  rankingmilitaryofficers,includingGeneralManuel_Contreras_Ԁhadbeeninvolvedinthe ` events. F 2.5Theauthorstatesthathisinvolvementintheinvestigationoftheeventsreferredtoabove  havecausedproblemsbothforhimselfandhisfamily.Inthisrespect,theauthorrefersto  anincident,inMayof1994,whichoccurredoutsideofhishomewheremembersofthe  policeforce(_carabineros_)helduphistwosons,firedatthemandarbitrarilyarrestedthemfor t severalhours.Theywerethenreleasedwithnocharges.Theyhadbeenaccusedofstealing Z acarandcarryingweapons.Theauthorallegesthattheseeventswereprovokedbythe @ _carabineros_,allegedlybecauseofhishumanrightsactivities.Hefileda_Recurso_Ԁde &v _AmparoSecretariat_ԀNote:Itwouldappearthattheauthor'sintentionwiththe_Recurso_Ԁde  \ _Amparo_wastocriminallyprosecutethoseresponsibleforthearbitraryarrestofhissons.on B behalfofhissonswhichwasdismissedanditisthisjudicialdecisionthatformsthebasis ( oftheauthor'ssecondcomplaint.  2.6Theauthorinitiatedproceedings,beforethe13thCriminalCourtofSantiago,againstthe   police(_carabineros_)whohadarrestedhissons.Theseproceedingsweredismissed p!  (sobreseimientototalytemporal),on21September1995,bythe"2ndMilitaryCourtof V"!
