R+&+ 2.2InJuly1994,afterXhadspokeninameetingofthisorganization,hishousewas -n(- ransackedbyfourarmedmilitiamen,wearingmilitaryuniforms.TheymishandledXand  threatenedhiswifeandson.Theauthorsreportedtheincidenttothepolice,butstatethatthe  policerefusedtowriteinthereporttherealreasonfortheattack.Thepoliceopenedan | inquiry,butintheendthecasewasfiledforlackofevidence. b 2.3TheauthorsstatethatinSeptember1994,theirchildwas_kidnapped_Ԁfromhisday . ~ nursery,allegedlybyfourmeninmilitaryuniforms.IntheeveningXandYreceiveda  d telephonecall,informingthemthattheirsonwouldbekilledunlesstheyleftthecountry.  J Subsequently,theauthorsarrangedforairplaneticketstoGermany,theirsonwasreturned  0 tothemandtheyleftthecountry.TwodaysaftertheirarrivalinGermany,theauthorsand    theirsonenteredtheNetherlandsandrequestedrecognitionasrefugees.    2.4On3November1994,theirrequestwasrejectedbytheSecretaryofJusticeandthey x  wereorderedtoleavethecountry.On2February1995,theauthors'appealagainstthe ^  refusaltograntthemaresidencepermitwasdeclaredinadmissible.On18July1995,the D  courtinTheHaguerejectedtheauthors'requestforanordertostaytheirexpulsion.Since *z  noappealpossibilityissaidtoexistagainstthecourt'sdecision,theauthorsclaimthatthey ` haveexhaustedallavailabledomesticremedies. F 2.5Itappearsfromtheenclosuresthattheauthorswerenolongerinpossessionoftheir  passportswhentheyenteredtheNetherlands.Thedocumentsfurthershowthatthe  Netherlandsauthoritieswereoftheopinionthattheauthors'storylackedcredibility,inter  alia,becauseXdidnotmentioninthefirsthearinghisactivitiesinsupportforsexualliberty t andhiswifehadnoknowledgeabouthisbisexuality;further,itwasnotedthattheauthors Z hadneverreportedtheabductionoftheirsontothelocalauthorities,sothatitcannotbesaid @ thattheauthoritiesfailedtogivethemprotection;nordidtheauthoritiesfindanyindication &v thattheallegedintimidationoftheauthors'familywaslinkedwithX'sactivities.Inthis  \ respectitisnotedthattheassaultinJuly1994wasreportedinthepolicereportasarobbery B andthatthereisnoindicationthattheallegedabductionoftheauthors'sonwasrelatedto ( X'sactivitiesorthatStateauthoritieswereinvolved.Furthermore,theauthorswereableto  leaveGeorgiawithavalidpassport,justifyingtheconclusionthattheauthorshadnot  negativelyattractedtheattentionoftheGeorgianauthorities.Inarrivingathisdecisionthe   NetherlandsSecretaryofJusticealsobasedhimselfoninformationfromtheMinistryof p!
