ÐUnder€the€legislation€then€applicable,€their€property€was€confiscated.€After€the€fall€of€theÐ Æ   ÐCommunist€government€on€17€November€1989,€the€Czech€authorities€published€statementsÐ ¬ ü  Ðwhich€indicated€that€expatriate€Czech€citizens€would€be€rehabilitated€in€as€far€as€anyÐ ’â  Ðcriminal€conviction€was€concerned,€and€their€property€restituted.€Ð xÈ  ÐÌ2.2€In€July€1990,€Mr.€and€Mrs.€Simunek€returned€to€Czechoslovakia€in€order€to€submit€aÐ D”  Ðrequest€for€the€return€of€their€property,€which€had€been€confiscated€by€the€District€NationalÐ *z  ÐCommittee,€a€State€organ,€in€Jablonece.€It€transpired,€however,€that€between€September€1989Ð ` Ðand€February€1990,€all€their€property€and€personal€effects€had€been€evaluated€and€auctionedÐ öF Ðoff€by€the€District€National€Committee.€Unsaleable€items€had€been€destroyed.€On€13Ð Ü, ÐFebruary€1990,€the€authors'€real€estate€was€transferred€to€the€Jablonece€Sklarny€factory,€forÐ Â Ðwhich€Jaroslav€Simunek€had€been€working€for€twenty€years.€Ð ¨ø ÐÌ2.3€Upon€lodging€a€complaint€with€the€District€National€Committee,€an€arbitration€hearingÐ tÄ Ðwas€convened€between€the€authors,€their€witnesses€and€representatives€of€the€factory€on€18Ð Zª ÐJuly€1990.€The€latter's€representatives€denied€that€the€transfer€of€the€authors'€property€hadÐ @ Ðbeen€illegal.€The€authors€thereupon€petitioned€the€office€of€the€district€public€prosecutor,Ð &v Ðrequesting€an€investigation€of€the€matter€on€the€ground€that€the€transfer€of€their€property€hadÐ  \ Ðwho€had€left€the€country€under€communist€pressure€and€lays€down€the€conditions€forÐ %X $ Ðrestitution€or€compensation€for€loss€of€property.€Under€Section€3,€subsection€1,€of€the€Act,Ð î%>!% Ðthose€who€had€their€property€turned€into€State€ownership€in€the€cases€specified€in€SectionÐ Ô&$"& Ð6€of€the€Act€are€entitled€to€restitution,€but€only€if€they€are€citizens€of€the€Czech€and€SlovakÐ º' #' ÐFederal€Republic€òòandóó€are€permanent€residents€in€its€territory.€Ð  (ð#( ÐÌ2.5€Under€Section€5,€subsection€1,€of€the€Act,€anyone€currently€in€(illegal)€possession€of€theÐ l*¼%* Ðremedy€ineffective,€as€they€do€not€fulfil€the€requirements€under€Section€3,€subsection€1.Ð à 0 ÐAlina€Simunek€adds€that€they€have€lodged€complaints€with€the€competent€municipal,Ð Æ   Ðprovincial€and€federal€authorities,€to€no€avail.€She€also€notes€that€the€latest€correspondenceÐ ¬ ü  Ðis€a€letter€from€the€Czech€President's€Office,€dated€16€June€1992,€in€which€the€author€isÐ ’â  Ðinformed€that€the€President's€Office€cannot€intervene€in€the€matter,€and€that€only€theÐ xÈ  Ðtribunals€are€competent€to€pronounce€on€the€matter.€The€author's€subsequent€letters€remainedÐ ^®  Ðwithout€reply.€Ð D”  ÐÌ2.7€Dagmar€Hastings€Tuzilova,€an€American€citizen€by€marriage€and€currently€residing€inÐ ` ÐSwitzerland,€emigrated€from€Czechoslovakia€in€1968.€On€21€May€1974,€she€was€sentencedÐ öF Ðòòin€absentiaóó€to€a€prison€term€as€well€as€forfeiture€of€her€property,€on€the€ground€that€she€hadÐ Ü, Ð'illegally€emigrated'€from€Czechoslovakia.€Her€property,€5/18€shares€of€her€family's€estateÐ Â Ðin€Pilsen,€is€currently€held€by€the€Administration€of€Houses€in€this€city.€Ð ¨ø ÐÌ2.8€By€decision€of€4€October€1990€of€the€District€Court€of€Pilsen,€Dagmar€Hastings€TuzilovaÐ tÄ Ðwas€rehabilitated;€the€District€Court's€earlier€decision,€as€well€as€all€other€decisions€in€theÐ Zª Ðcase,€were€declared€null€and€void.€All€her€subsequent€applications€to€the€competentÐ @ Ðauthorities€and€a€request€to€the€Administration€of€Houses€in€Pilsen€to€negotiate€the€restitutionÐ &v Ðof€her€property€have,€however,€not€produced€any€tangible€result.€Ð  \ ÐÌ2.9€Apparently,€the€Administration€of€Housing€agreed,€in€the€spring€of€1992,€to€transfer€theÐ Ø( Ð5/18€of€the€house€back€to€her,€on€the€condition€that€the€State€notary€in€Pilsen€agreed€toÐ ¾ Ðregister€this€transaction.€The€State€notary,€however,€has€so€far€refused€to€register€the€transfer.Ð ¤ô ÐAt€the€beginning€of€1993,€the€District€Court€of€Pilsen€confirmed€the€notary's€action€(CaseÐ Š Ú ÐNo.€11€Co.€409/92).€The€author€states€that€she€was€informed€that€she€could€appeal€thisÐ p!À  Ðdecision,€via€the€District€Court€in€Pilsen,€to€the€Supreme€Court.€She€apparently€filed€anÐ V"¦! Ðappeal€with€the€Supreme€Court€on€7€May€1993,€but€no€decision€had€been€taken€as€of€20Ð <#Œ" ÐJanuary€1994.€Ð "$r# ÐÌ2.10€On€16€March€1992,€Dagmar€Hastings€Tuzilova€filed€a€civil€action€against€theÐ î%>!% ÐAdministration€of€Houses,€pursuant€to€Section€5,€subsection€4,€of€the€Act.€On€25€May€1992,Ð Ô&$"& Ðthe€District€Court€of€Pilsen€dismissed€the€claim,€on€the€ground€that,€as€an€American€citizenÐ º' #' Ðresiding€in€Switzerland,€she€was€not€entitled€to€restitution€within€the€meaning€of€Section€3,Ð  (ð#( Ðsubsection€1,€of€Act€87/1991.€The€author€contends€that€any€appeal€against€this€decisionÐ †)Ö$) Ðwould€be€ineffective.€Ð l*¼%* ÐÌ2.11€Josef€Prochazka€is€a€Czech€citizen€born€in€1920,€who€currently€resides€in€Switzerland.Ð 8,ˆ', ÐHe€fled€from€Czechoslovakia€in€August€1968,€together€with€his€wife€and€two€sons.€In€theÐ -n(- Ðformer€Czechoslovakia,€he€owned€a€house€with€two€three„bedroom€apartments€and€a€garden,Ð ° Ðas€well€as€another€plot€of€land.€Towards€the€beginning€of€1969,€he€donated€his€property,€inÐ –æ Ðthe€appropriate€form€and€with€the€consent€of€the€authorities,€to€his€father.€By€judgments€ofÐ |Ì Ða€district€court€of€July€and€September€1971,€he,€his€wife€and€sons€were€sentenced€to€prisonÐ b² Ðterms€on€the€grounds€of€"illegal€emigration"€from€Czechoslovakia.€In€1973,€JosefÐ H˜ ÐProchazka's€father€died;€in€his€will,€which€was€recognized€as€valid€by€the€authorities,€theÐ . ~ Ðauthor's€sons€inherited€the€house€and€other€real€estate.€Ð  d ÐÌ2.12€In€1974,€the€court€decreed€the€confiscation€of€the€author's€property,€because€of€his€andÐ à 0 Ðhis€family's€"illegal€emigration",€in€spite€of€the€fact€that€the€authorities€had,€several€yearsÐ Æ   Ðearlier,€recognized€as€lawful€the€transfer€of€the€property€to€the€author's€father.€In€DecemberÐ ¬ ü  Ð1974,€the€house€and€garden€were€sold,€according€to€the€author€at€a€ridiculously€low€price,Ð ’â  Ðto€a€high€party€official.€Ð xÈ  ÐÌ2.13€By€decisions€of€26€September€1990€and€of€31€January€1991,€respectively,€the€DistrictÐ D”  ÐCourt€of€Ust€rehabilitated€the€author€and€his€sons€as€far€as€their€criminal€conviction€wasÐ *z  Ðconcerned,€with€retroactive€effect.€This€means€that€the€court€decisions€of€1971€and€1974€(seeÐ ` Ðparagraphs€2.11€and€2.12€above)€were€invalidated.€Ð öF ÐÌòòThe€complaintóó:€Ð  ÐÌ3.1€Alina€and€Jaroslav€Simunek€contend€that€the€requirements€of€Act€87/1991€constituteÐ ŽÞ Ðunlawful€discrimination,€as€it€only€applies€to€"pure€Czechs€living€in€the€Czech€and€SlovakÐ tÄ ÐFederal€Republic".€Those€who€fled€the€country€or€were€forced€into€exile€by€the€ex„Ð Zª Ðcommunist€regime€must€take€a€permanent€residence€in€Czechoslovakia€to€be€eligible€forÐ @ Ðrestitution€or€compensation.€Alina€Simunek,€who€lived€and€worked€in€Czechoslovakia€forÐ &v Ðeight€years,€would€not€be€eligible€at€all€for€restitution,€on€account€of€her€Polish€citizenship.Ð  \ ÐThe€authors€claim€that€the€Act€in€reality€legalizes€former€Communist€practices,€as€more€thanÐ òB Ð80%€of€the€confiscated€property€belongs€to€persons€who€do€not€meet€these€strictÐ Ø( Ðrequirements.€Ð ¾ ÐÌ3.2€Alina€Simunek€alleges€that€the€conditions€for€restitution€imposed€by€the€Act€constituteÐ Š Ú Ðdiscrimination€on€the€basis€of€political€opinion€and€religion,€without€however€substantiatingÐ p!À  Ðher€claim.€Ð V"¦! ÐÌ10.1€By€letter€of€21€February€1995,€Alina€and€Jaroslav€Simunek€contend€that€the€State€partyÐ ^®  Ðhas€not€addressed€the€issues€raised€by€their€communication,€namely€the€compatibility€of€ActÐ D” ÐDistrict€Court€of€12€April€1995€the€plot€of€land€he€inherited€from€his€father€will€be€returnedÐ tÄ Ðto€him€(paragraph€2.11).€Ð Zª ÐÌ10.3€Mrs.€Hastings€Tuzilova€had€not€submitted€comments€by€the€time€of€the€considerationÐ &v Ðof€the€merits€of€this€communication€by€the€Committee.€Ð  \ ÐÌòòExamination€of€the€meritsóó€Ð Ø( ÐÌ11.1€The€Human€Rights€Committee€has€considered€the€present€communication€in€the€lightÐ ¤ô Ðof€all€the€information€made€available€to€it€by€the€parties,€as€provided€in€article€5,€paragraphÐ Š Ú
