ÐÌ7.2€As€to€the€impartiality€of€the€jurors,€the€State€party€reiterates€its€earlier€observation€(seeÐ "$r# Ðpara.€2.5€above).€It€adds€that€the€person€who€had€made€the€inimical€remarks€during€courtÐ %X $ Ðrecess,€Ms.€J.,€is€a€salaried€worker€who,€in€1990,€earned€less€income€than€the€author€receivedÐ î%>!% Ðin€terms€of€social€benefits€during€the€same€year.€In€these€circumstances,€the€State€partyÐ Ô&$"& Ðsubmits,€the€rather€general€remarks€of€Ms.€J.€were€"a€not€very€surprising€reaction€to€a€matterÐ º' #' Ðthat€must€have€seemed€unjust€to€her."Ð  (ð#( ÐÌ7.3€The€State€party€recalls€that€the€issue€of€whether€the€fact€that€the€remark€was€made€meantÐ l*¼%* Ðguilt.€This€is€common€practice,€based€on€the€principle€that€a€defendant€shall€be€judged€byÐ Ü, Ðequals€...€This€principle€would€be€of€little€value€if€the€jury's€assessment€of€evidence€...€couldÐ Â Ðbe€overruled€by€the€professional€judges€in€the€Supreme€Court".Ð ¨ø ÐÌ7.5€As€to€the€admissibility€of€the€evidence€placed€before€the€High€Court€and€the€allegedÐ tÄ Ðthat€the€most€likely€explanation€for€S.€B.'s€attitude€in€court€was€his€fear€of€reprisals€if€heÐ òB Ðupheld€his€earlier€statement;€it€notes€that€S.€B.,€himself€a€detainee€at€the€prison€of€Bergen,Ð Ø( Ðthis€is€what€occurred€in€the€author's€case.€The€State€party€explains€that€the€reason€why€theÐ à 0 Ðapplicable€provision€may€be€changed,€after€indictment€but€before€start€of€the€trial,€is€that€theÐ Æ   Ðdefendant€is€not€being€charged€with€a€new€offence;€it€is€simply€a€question€of€choosing€theÐ ¬ ü  Ðappropriate€provision€applicable€to€the€same€facts.Ð ’â  ÐÌ7.9€Finally,€as€to€the€duration€of€Mr.€Ô_ÔNarrainenÔ_Ô's€pretrial€detention,€the€State€party€reiteratesÐ ^®  Ðits€comments€detailed€in€paragraph€4.5€above.€As€to€the€quality€of€his€counsel,€it€recalls€thatÐ D”  Ðsince€the€author€"was€imprisoned€in€Oslo,€he€had€the€opportunity€to€choose€between€manyÐ *z  Ðhighly€qualified€lawyers".€It€explains€that€when€the€court€has€appointed€a€legal€aidÐ ` Ðrepresentative,€it€will€not€appoint€another€one€unless€asked€to€do€so€by€the€defendant;Ð öF Ðtherefore,€any€lawyer€assisting€Mr.€Ô_ÔNarrainenÔ_Ô€Ô_Ômust€have€been€chosen€pursuant€to€hisÐ Ü, Ðrequests.€The€State€party€concludes€that€there€is€no€reason€to€believe€that€Mr.€Narrainen€didÐ Â Ðnot€receive€the€same€legal€services€as€any€other€accused.€Rather,€he€was€given€everyÐ ¨ø Ðopportunity€to€request€a€new€representative€every€time€he€was€dissatisfied€with€his€previousÐ ŽÞ Ðabout€the€composition€of€juries€under€the€criminal€justice€system.€According€to€recentÐ &v Ðstatistics,€43€per€cent€of€foreign€nationals€residing€in€Norway€live€in€Oslo€or€neighbouringÐ  \ Ðboroughs.€Of€the€foreign„born€Norwegian€citizens€some€60,516,€of€whom€half€come€fromÐ òB ÐLatin€America,€Asia€and€Africa,€lived€in€Oslo.€Between€10€and€15€percent€of€all€personsÐ Ø( Ðliving€in€Oslo€have€cultural€and€ethnic€backgrounds€that€differ€from€the€rest€of€theÐ ¾ Ðpopulation.Ð ¤ô ÐÌ8.2€Counsel€observes€that€few€if€any€foreigners€or€foreign„born€Norwegians€figure€in€listsÐ p!À  Ðfrom€which€jury€members€are€selected.€Eidsivating€High€Court€was€unwilling€to€provide€himÐ V"¦!
