H-(, 2.2InJanuary1988,theauthorattendedapublicgatheringorganizedbythe_UDPS_.Whenmilitarypolicearrivedtodispersethemeeting,theauthorfledtohisparents'house.Therehelearnedthathisrelativehadbeenarrested.Thenextmorning,at5.30a.m.,policearrivedattheauthor'shouseanddetainedhim.Theauthorclaimsthatthepolicetookhimtoaroomtobetortured,inordertomakehimdisclosethenamesofthosewhoattendedthemeetingsinhisrelative'shouse.Whentheauthorrefusedtocomply,hewasaccusedofconspiracyagainsttheRepublic.Intheeveningofthefifthdayofdetention,theauthorwasreleased,thankstotheinterventionofafriendofhisbrother.2.3Afterhavingstayedwithafriendforabriefperiodoftime,hisbrotherdrovehimtoanothertown,wherehestayedwithanotherbrother.Aboutayearlater,theauthor,throughhisbrother,obtainedafalsepassportandboardedanAirZaireplaneforRome.AfterhisarrivalinRome,theauthorsoughthelptogoacrosstheborderwithSwitzerland.2.4UponarrivalinSwitzerland,theauthor,inFebruary1989,requestedrecognitionasarefugee.Hewasheardbythe Officecantonaldes_demandeurs_Ԁ_d'asile_ inGeneva,inMay   1989.InJuly1992,the Office_fdral_Ԁdes_rfugis_ rejectedhisrequest.Theauthor'sappeal t wasrejectedbythe Commission_suisse_Ԁde_recours_Ԁen_matire_Ԁ_d'asile_Ԁetde_renvoi_ inMay d 1994.TheauthorandhiscompanionwereorderedtoleaveSwitzerlandbeforeoron30August1994,failingwhichhewouldbereturnedtoZaire.InAugust1994,hispermitwasextendeduntil30September1994.2.5TheauthorfurtherstatesthathewasjoinedbyhisgirlfriendinNovember1991,thattheyarewellintegratedinsociety,andthattheyhavefoundemployment. Thecomplaint :  3.1TheauthorarguesthatheoweshislifetohavingfledZaire.HeclaimsthathecannotgobacktoZairewithoutendangeringhissecurity.Hearguesthat,sincehedoesnotpossessproperidentificationpapers,hewillbeimmediatelyarrestedonarrivaland,sinceheisknownasamemberoftheUDPS,hewillbekeptindetentionandprobablysubjectedtotorture.HestatesthatinZaireaconsistentpatternofgross,flagrantormassviolationsofhumanrightsexists,andthatforthisreasonalonetheSwissauthoritiesshouldrefrainfromreturninghim.HefurthersubmitsthatthesimplefactofapplyingforasylumisconsideredinZaireasasubversiveact.3.2PendingtheCommittee'sdecisiononthemeritsofhiscommunication,theauthorrequeststheCommitteetorequestSwitzerland,underrule108,paragraph9,oftheCommittee'srulesofprocedure,nottoimplementtheexpulsionorderagainsthimandhiscompanion.
