DistrictPrison,Jamaica. <#" 2.1L.G.statesthathewasinterrogatedbythepoliceathishomeontheeveningof7 %X $ October1985inconnectionwiththemurderofMr.T.M.Thelatterhadbeenkilledwitha %>!% macheteinthecourseofarobberythatoccurredintheparishofHanoveron2October1985, &$"& over150milesawayfromtheauthor'shome.Theauthorexplainedthat,whileheknewthe ' #' victimfromtheperiodwhenhelivedinHanover,hehadnotvisitedthattownfora (#( considerabletimeandknewnothingaboutthecrime.Hewas,however,arrestedin )$) connectionwiththeincident.On25October1985,theauthorwasputonanidentification l*%* parade,wherehewasidentifiedbyMs.E.M.,whomhealsoknew.Hewassubsequently R+&+ chargedwiththemurderofMr.M.,togetherwithhisbrother,V.G.,whowasthenlivingin 8,', Hanover. -n(- Ї2.2TheauthorandhisbrotherwereconvictedandsentencedtodeathintheHanoverDistrict  Courton7November1986.TheCourtofAppealdismissedtheauthor'sappealbutacquitted  thebrotheron5October1987.AnappealtotheJudicialCommitteeofthePrivyCouncilhas | yettobemade. b 2.3Throughoutthetrialandtheappeal,theauthorwasrepresentedbylegalaidattorneys; . ~ Ms.P.S.representedhimbeforetheDistrictCourt,Mr.D.C.beforetheCourtofAppeal.  d TheauthorstatesthattwoLondonbasedattorneyshaveagreedtoassisthimwiththe  J preparationofapetitionforleavetoappealtotheJudicialCommitteeofthePrivyCouncil.  0 2.4TheauthorraisesanumberofquestionspertainingtohisidentificationbyMs.M.and    byanotherman,onthebasisofwhichhewasconvicted.Theothermanallegedlytestified   thathehadseentheauthorinabananafieldthesceneofthecrime.Yet,becausetheauthor x  wasmasked,accordingtothewitness,hecouldonlyrecognizeandidentifytheauthor'sbuild ^  andotherphysicalfeatures,nothisface.Intheauthor'sview,thatwasinsufficienttoallow D  properidentification. *z  3.Uponregisteringthecommunicationon21March1988,theWorkingGroupofthe F HumanRightsCommitteeinstructedtheSecretariattoseekfurtherinformationfromthe , authoraboutanumberofissuespertainingtohiscommunication,inparticularaboutthe  questionofexhaustionofdomesticremedies.  4.Byaletterdated3June1988,theauthor,inresponse,informedtheCommitteethathis t legalrepresentativesinLondonhadinformedhimthatthereweregoodgroundsforhimto Z appealtotheJudicialCommitteeofthePrivyCouncilandthattheywereintheprocessof @ preparingapetitionforleavetoappealonhisbehalf. &v 5.1Beforeconsideringanyclaimscontainedinacommunication,theHumanRights B Committeemust,inaccordancewithrule87ofitsprovisionalrulesofprocedure,decide ( whetherornotitisadmissibleundertheOptionalProtocoltotheCovenant.  5.2TheCommitteehasascertained,asitisrequiredtodounderarticle5,paragraph2(a),   oftheOptionalProtocol,thatthesamematterisnotbeingexaminedunderanother p!  procedureofinternationalinvestigationorsettlement.
