L  2.3TheauthorclaimsthathewasagainarrestedinNovember1992andeventuallybroughttothe $  _Osjtj_Ԁ2911prisonin_Balti_,inthenorthofMoldova.Theauthorwasunofficiallytoldthathewas   arrestedbecauseofhisserviceintheBenderguards.Hewasallegedlyheldforalmostthreeyears   withouttrial.Theauthorsubmitsthatwhileinprisonhewasrepeatedlysubjectedtoabusiveand   degradingilltreatment.Hewasallegedlybeatenbyotherprisonersbetween40and50times,which   resultedinlossofconsciousnessonseveraloccasions.Theprisonguardsnotonlyignoredhis p treatmentbytheotherprisoners,butinstigatedandcontributedtoit,andoccasionallyputhimina \ solitaryconfinementcell.Theauthorfurthersubmitsthattheprisonguardsalsomistreatedhimby H beatingandkickinghim,mainlyonthehead. 4 2.4InAugust1993,theauthorwassentencedto13yearsinprison,presumablyfortreason,illegal  \ possessionofweaponsandresistingarrest.Twoyearslater,inAugust1995,theauthorwasagain H broughttocourtasawitnessinanothertrialandmanagedtoescapefromthethreeprisonguards 4 escortinghim.TheauthorarrivedinSweden,viaUkraine,RussiaandFinland,on15December1995   andappliedforasylumthefollowingday.   2.5On21October1996theSwedishBoardofImmigrationrejectedtheauthor'srequest.Theauthor  appealedthedecisiontotheAliensAppealBoardandfollowinganadditionaloralhearingwiththe  authoron5February1999theappealwasrejectedon18March1999. l Complaint D! 3.Withreferencetothefactspresented,theauthorfearsthathewillbesubjectedtorenewedtorture #l! ifheisreturnedtoMoldovaandthathisforcedreturnwouldthereforeconstituteabreachbySweden $X" ofarticle3oftheConvention. $D # Stateparty'sobservationsonadmissibility &"% 4.1On22June1999theCommitteetransmittedthecommunicationtotheStatepartyforcomment.
