' #' 2.7On5August1991,theauthorrequestedtheFederalCourtofCanada,TrialDivision,for )$) awritof certiorari ,inordertoquashtheCommission'sdecisionandtoforceittohavehis l*%* caseexaminedbythe Tribunaldesdroitsdelapersonne .Theauthorclaimedprocedural R+&+ deficienciesduringthehandlingofhiscasebytheCommission,suchasthefailuretohave 8,', theauthormedicallyexaminedbyindependentexpertsandthedisappearancefromthefile -n(- ofpresscuttingsabouttheauthor'sathleticachievements.On20September1991,theCourt  rejectedtheauthor'srequest,consideringthattheCommissionhadexerciseditsdiscretion  incompliancewiththelawandtheprinciplesoflawestablishedinjurisprudence.Thejudge | alsonotedthattheCommission'sdecisiondidnotaffecttheauthor'srighttosuetheRCMP b forallegeddamages.Theauthorsubmitsthat,sincethejudgedidnoterrinlaw,appealfrom H hisjudgementisnotpossible. . ~ Thecomplaint:  J 3.TheauthorclaimsthatheisavictimofdiscriminationbytheRCMP.Hefurthercontends    thattheCanadianHumanRightsCommissionhasviolatedtherulesoffairprocedureand    hasdiscriminatedagainsthimbyacceptingtheinsufficientexplanationbytheRCMP.He   claimsthatthefactsasdescribedamounttoviolationsofarticles14and26oftheCovenant. x  IssuesandproceedingsbeforetheCommittee: D  4.1Beforeconsideringanyclaimcontainedinacommunication,theHumanRights ` Committeemust,inaccordancewithrule87ofitsrulesofprocedure,decidewhetherornot F itisadmissibleundertheOptionalProtocoltotheCovenant. , 4.2TheCommitteenotesthattheauthorclaimsheisavictimofdiscriminationbythe  RCMP,becausehewasrefusedapostasaconstablesolelyonthebasisofhismedical  history.TheCommitteefurthernotesthatthepoliceacknowledgedhavingmadeamistake t intheprocedureandinvitedtheauthortoreapply.Theauthor,however,failedtoacceptthe Z offermadebythepolice,demandingmonetarycompensationinstead.TheCommittee @ considersthattheauthorhasfailedtosufficientlysubstantiate,forpurposesofadmissibility, &v thattheproposalmadetohimbythepolicewasnoteffectiveandcouldnotleadtoaremedy.  \ Theauthorthereforehasnoclaimunderarticle2oftheOptionalProtocol.
