Šwas€carried€out€in€an€open€yard,€in€mid„winter,€with€the€victim€naked,€and€happened€onlyŠ <#Œ" Šonce.€As€a€result,€she€lost€consciousness,€so€that€she€is€unable€to€say€how€long€she€was€keptŠ "$r# Šin€that€position;€Š %X $ ŠĢ"(d)€ņņVarious€forms€of€continuous€degradation€and€violence,€óósuch€as€always€having€to€remainŠ Ō&$"& Šnaked€with€the€guards€and€torturers,€threats€and€insults€ant€promises€of€further€acts€ofŠ ŗ' #' Šcruelty.€Š  (š#( ŠĢ"I€am€unable€to€state€specifically€the€ņņeffect€and€result€óóof€this€treatment€in€the€case€of€myŠ l*¼%* Šniece,€because€it€has€not€yet€been€possible€to€obtain€any€clinical€information€or€to€have€herŠ R+¢&+ Šexamined€by€a€reliable€doctor.€However,€there€are€a€number€of€symptoms€which€give€causeŠ 8,ˆ', Šfor€alarm€in€this€regard.€After€being€strung€up,€as€described€above,€my€niece€suffered€attacksŠ -n(- Šof€vomiting€and€other€symptoms,€as€a€result€of€which€she€was€taken€on€a€numbs€ofŠ ° Šoccasions,€after€her€trial€and€transfer€to€her€current€place€of€imprisonment,€for€examinations,Š –ę Šthe€nature€and€results€of€which€it€has€not€been€possible€to€ascertain.€It€is€known,€however,Š |Ģ Šthat€some€of€the€examinations€involved€electro„encephalograms.€In€this€regard,€it€should€beŠ b² Šborne€in€mind€that,€as€I€stated€in€my€initial€communication,€my€niece€contracted€meningitisŠ H˜ Šlast€year.€The€blows€to€the€head€which€she€received€were€therefore€particularly€dangerousŠ . ~ Šin€her€case."€Š  d ŠĢ4.4€Mrs.€Reverdito€further€claimed€that€her€niece€was€held€at€the€political€prison€for€womenŠ ą 0 Šat€Punta€de€Rieles€(Military€Detention€Establishment€No.€2),€13€kilometres€fromŠ Ę   ŠMontevideo,€that€the€treatment€which€she€was€receiving€there€was€in€gross€violation€of€theŠ ¬ ü  Šstandards€provided€for€in€the€Covenant€(and€in€the€Uruguayan€Constitution).€The€methodsŠ ’ā  Šused€were€allegedly€intended€gradually€to€destroy€the€personalities€of€detainees€byŠ xČ  Šcontinuously€assaulting€their€psychological€equilibrium€and€undermining€their€physicalŠ ^®  Šintegrity:€'The€means€employed€there€do€not€involve€direct€brutal€torture,€but€are€calculatedŠ D”  Što€work€slowly,€gradually€and€cumulatively.€They€involve€deliberately€arbitrary€treatmentŠ *z  Šcontinuous€harassment,€inadequate€nutrition,€physical€labour€and€other€forms€of€harshŠ ` Štreatment€which€produce€long„term€effects.'€Š öF ŠĢ5.€In€its€submission€under€rule€91,€dated€31€January€1984,€the€State€party€commented€on€theŠ Ā Šauthor's€initial€communication€and€also€on€her€further€submission€of€3€November€1983,€andŠ Øų Šinformed€the€Committee€that€Lucia€Arzuada€Gilboa€bad€been€brought€to€trial€for€the€offenceŠ ŽŽ Šof€"subversive€association'.€provided€for€in€article€60€(V)€of€the€Military€Criminal€Code,€andŠ tÄ Šthat€no€judgement€had€yet€been€rendered€at€first€instance.€"Consequently,€the€GovernmentŠ ZŖ Šof€Uruguay,€in€accordance€with€article€5,€paragraph€2€(b),€of€the€Optional€Protocol€to€theŠ @ ŠInternational€Covenant€on€Civil€and€Political€Rights,€opposes€the€admissibility€of€theŠ &v Šcommunication€in€question€on€the€grounds€that,€given€the€stage€which€the€trial€proceedingsŠ  \ Šhave€reached,€remedies€are€still€available€under€the€relevant€internal€legislation.€TheŠ ņB ŠCommittee€is€informed,€however,€that€the€state€of€health€of€Arzuada€Gilboa€is€good."€Š Ų( ŠĢ6.€In€a€further€letter€dated€20€March€1984,€Mrs.€Reverdito€reiterated€that€there€ere€no€internalŠ ¤ō Šremedies€which€could€have€been€applied€effectively€and€that€the€military€criminalŠ Š Ś Šproceedings€themselves€constituted€a€breach€of€the€guarantees€aid€down€in€article€14€of€theŠ p!Ą  ŠCovenant.€Š V"¦!
