R+&+ Togetherwithsomecolleagueswhofoundthemselvesinasimilarposition,heinstituted 8,', judicialproceedingsrequestinghisre_instatement_Ԁasearlyastheyear1977. -n(- Ї2.2Afterthecountry'stransitiontodemocraticrule,on7November1985,heobtaineda  _favourable_Ԁjudgment(_Sentencia_ԀNo.17)fromalocaltribunalinMontevideo,whichordered  thedefendantsi.e.theMinistryofEducationandtheStateUniversitytocompensatethe | authorforallthematerialandmoralprejudicethathehadsuffered.Subsequently,hewas b reintegratedintothecivilservice.Byaninterlocutoryjudgmentof31July1987(handed H _downby_Ԁanadministrativetribunal_Juzgado_Ԁde_Primera_Ԁ_Instancia_Ԁenlo_Contencioso_ . ~ _Administrativo_),accruedinterestsonthecompensationduetotheauthorwerecomputedat  d anannualrateof12.3%.  J 2.3Theauthorcomplainsthatinspiteoftheabovejudicialdecisions,theauthoritieshave    failedtofullyexecutetheirterms.AlthoughtheExecutiveBranchdid,inprinciple,    acknowledgeitsobligationsvisvistheauthorasearlyas1989,ithas,accordingtoMr.   _Veiga_,adopteddeliberatelydilatorytactics,designedtopreventthepaymentoffulland x  inflationadjustedcompensation. ^  2.4AftertheelectionofPresidentDr.Luis_Lacalle_Ԁin1990,theauthorsubmittedhisfileto *z  thePresident'soffice;hiscasewasthenregisteredasfileNo.87/91beforetheUruguayan ` GeneralAccountingOffice(_Contadura_Ԁdela_Naci;n_),whereitapparentlyremainspending. F Theauthorsuspectsthatnofollowupwillbegivenbythisoffice,either.Norhavethe , author'snumerousother,administrative,demarches,recordedinanotherfile(No.  _MEF_/89/01/8501),beensuccessful.  2.5TheauthorrequeststheintercessionoftheHumanRightsCommittee,withaviewto t obligingtheUruguayanauthoritiestoexecutethejudgmentof1985inhis_favour_. Z Thecomplaint: &v 3.1AlthoughtheauthordoesnotinvoketheprovisionsoftheInternationalCovenanton B CivilandPoliticalRights,ittranspiresthatheclaimsthatheisbeingdeniedaneffective ( remedy,andthatheisunlawfullydeniedfullcompensationawardedtohimbydecisionof  acourtoflaw.ItthereforeappearsthatheclaimsaviolationbyUruguayofarticle2,  paragraph3,oftheCovenant.   TheStateparty'sinformationandobservationsandtheauthor'scomments: V"! 4.1Initssubmissionunderrule91oftherulesofprocedure,theStatepartyindicatesthat "$r# bydecisionoftheMinistryofEconomicsandFinancedated5February1992,aspecified %X $ sumwastransferredtotheStateUniversity,withaviewtopaytotheauthortheamountof %>!% compensationduetohim,togetherwithinflationadjustmentsandinterests,soastocomply &$"& withthetermsofthedecisionoftheadministrativetribunalof31July1987. ' #' 4.2Underthetermsofthedecisionof5February1992,asumofN$(_Nuevos_ԀPesos) )$) 111,934,098.00shouldhavebeenpaidtotheauthor,butthepaymentonlycoveredthe l*%* perioduntil7December1989.Thisdate,itappears,wasnotchosenarbitrarilybutin R+&+ accordancewitharticle686ofLaw16,170of28December1990. 8,',  -n(- _5.1Inhiscomments,theauthortakesissuewiththeStateparty'sobservations.Henotesthat  thesummentionedintheresolutionof5February1992,whichwassupposedtocoverthe  perioduntilDecember1989,wasonlypaidinApril1992andinthemonthsbetween | December1989andApril1992,inflationhadbeenintheorderof230%,whichmeantthat b themonetaryvalueofthecompensatorypaymenthadbeenseverelydiminishedinreal H terms.TheauthorcomplainsthattheStateparty'sauthoritiesdeliberatelydelayedthe . ~ paymentofhiscompensation,andthattheydeliberatelydisregardedthetermsofthe  d interlocutoryjudgmentof31July1987.
